【摘要】：傳統(tǒng)奧地利侵權(quán)法對(duì)"精神打擊"案件受害人給予賠償?shù)牧?chǎng)相對(duì)保守。進(jìn)入21世紀(jì),奧地利最高法院通過(guò)一系列判決逐步建立起一套較為完善的"精神打擊"損害賠償制度,并推動(dòng)了《奧地利損害賠償法草案》相關(guān)條款的制定�！肚謾�(quán)責(zé)任法》中的精神損害賠償制度能否適用于"精神打擊"案件尚存爭(zhēng)議。由于法律傳統(tǒng)相近,奧地利"精神打擊"損害賠償制度的發(fā)展為我國(guó)相關(guān)制度的構(gòu)建提供了有益的指引。
[Abstract]:The traditional Austrian tort law is relatively conservative in its position of compensation for victims of "mental strike" cases.In the 21st century, through a series of judgments, the Supreme Court of Austria has gradually established a relatively perfect system of "mental strike" compensation for damages.It also promotes the formulation of the relevant provisions of the Austrian draft Law on compensation for damage. Whether the system of compensation for mental damage in the Tort liability Act can be applied to the case of "mental strike" remains controversial.Because of the similar legal tradition, the development of the "spirit strike" damages system in Austria provides beneficial guidance for the construction of the relevant system in our country.
