【摘要】：民族習慣法在民事司法中的適用體現(xiàn)了我國民族地區(qū)司法國情的特殊性、司法的文化內(nèi)涵與和諧社會的法治要求,有其必要性。民族習慣法適用于民事司法存在體制保障的缺失、對民族習慣法缺乏必要的調(diào)查和匯編、民族地區(qū)法官適用民族習慣法的意識有待加強等方面的困境。民族地區(qū)應該通過建立善良民族習慣法的認定標準、整理和匯編民族習慣法民事司法適用案例、加強對民族地區(qū)民眾利用民族習慣法的引導、培育民族地區(qū)法官自覺運用民族習慣法的意識理念等方面的措施,以為民族習慣法在民事司法中的適用提供保障。
[Abstract]:The application of national customary law in civil justice reflects the particularity of judicial conditions in ethnic regions of our country. The cultural connotation of judicature and the requirement of the rule of law in a harmonious society are necessary.National customary law is applicable to the lack of institutional protection of civil justice, lack of necessary investigation and compilation of national customary law, the awareness of the application of national customary law by judges in ethnic areas needs to be strengthened, and so on.Ethnic areas should establish standards for the identification of good national customary laws, collate and compile cases of civil judicial application of national customary laws, and strengthen the guidance to the people in minority areas in using national customary laws.In order to provide protection for the application of national customary law in civil justice, the measures of cultivating judges in minority areas to consciously apply the consciousness of national customary law and other measures are put forward in order to ensure the application of national customary law in civil justice.
