【摘要】： 近年來,我國高職學(xué)生實(shí)習(xí)傷害事故不斷,但其責(zé)任認(rèn)定尚無明確的法律規(guī)定,在實(shí)踐中和理論上均有爭(zhēng)議,有深入研究的必要。 本文認(rèn)為高職學(xué)生實(shí)習(xí)傷害事故是高職院校組織的校外頂崗實(shí)習(xí)活動(dòng)及其負(fù)有管理職責(zé)的場(chǎng)所中造成實(shí)習(xí)學(xué)生人身損害后果的事故。在責(zé)任認(rèn)定中,應(yīng)認(rèn)定實(shí)習(xí)學(xué)生仍為學(xué)生身份,而不是勞動(dòng)者;實(shí)習(xí)學(xué)生與學(xué)校是教育管理關(guān)系,學(xué)校與實(shí)習(xí)企業(yè)是一種以學(xué)生為關(guān)系人的實(shí)習(xí)合同關(guān)系,實(shí)習(xí)學(xué)生與實(shí)習(xí)企業(yè)是一種以實(shí)習(xí)合同為依托的教育管理關(guān)系;責(zé)任認(rèn)定中歸責(zé)原則應(yīng)具體問題具體分析;學(xué)校與實(shí)習(xí)企業(yè)的責(zé)任主要是侵權(quán)責(zé)任,并應(yīng)處理好侵權(quán)責(zé)任與違約責(zé)任的競(jìng)合問題。
[Abstract]:In recent years, the practice injury accident of higher vocational college students in our country is unceasing, but there is no clear legal stipulation on its responsibility determination, which is controversial in practice and theory, so it is necessary to study deeply. In this paper, the author thinks that the injury accident of higher vocational college students' practice is the accident that caused the personal injury to the students in the place where they are responsible for management, which is organized by the higher vocational college. It should be recognized that the student is still a student, not a laborer, that the student and the school are educational management relations, and that the school and the internship enterprise are an internship contract with the student as the related person. Intern student and practice enterprise is a kind of educational management relationship based on internship contract; the principle of imputation should be analyzed concretely; the responsibility of school and practice enterprise is mainly tort liability. And should deal with tort liability and breach of contract liability of the competing problem.
