【摘要】： 改革開放以來,中國的法律發(fā)展在取得顯著成就的同時,也暴露出了一些問題,其中最為突出的便是法的實效性不足以及與之相伴的社會失序問題。本文認為,在社會轉(zhuǎn)型的視野下,這一問題的存在并不像本土資源論等批判性理論所認為的那樣,意味著以法制現(xiàn)代化為目標、以國家法為重心、以法律移植為主要途徑的政府推進型法律發(fā)展道路的錯誤和失敗,因為以國家法為重心是現(xiàn)代法治和市場經(jīng)濟的必然要求,法律移植也順應了外生后發(fā)型現(xiàn)代化和全球化的必然趨勢,而政府推進則源于中國獨特的東方傳統(tǒng)和現(xiàn)實社會結(jié)構(gòu)。所以,本土資源論等批判性理論對歷史唯物論、地方性知識、進化論理性主義和市民社會等理論的解讀和運用存在一定的偏頗:它們忽略了社會轉(zhuǎn)型和中國結(jié)構(gòu)這一獨特的時空背景,也忽略了法制現(xiàn)代化理論和中國法律發(fā)展實踐的辯證色彩。因此,在社會轉(zhuǎn)型和秩序重構(gòu)的視野下,中國應當堅定法制現(xiàn)代化的目標和改革開放以來所奉行的法律發(fā)展道路。
[Abstract]:Since the reform and opening up, China's legal development has made remarkable achievements, but also exposed some problems, the most prominent of which is the lack of effectiveness of the law and the accompanying social disorder. From the perspective of social transformation, the existence of this problem does not mean that the modernization of the legal system is the goal and the national law is the focus, as the critical theories such as the native resource theory think. The mistakes and failures of the government's way of promoting the development of law, which take the law transplant as the main way, because the focus of the national law is the inevitable requirement of the modern rule of law and the market economy. The transplantation of law also conforms to the inevitable trend of exogenous hairstyle modernization and globalization, and the government's promotion originates from China's unique oriental tradition and realistic social structure. The interpretation and application of local knowledge, evolutionary rationalism and civil society are biased: they ignore the unique space-time background of social transformation and Chinese structure. It also ignores the dialectical color of the theory of legal modernization and the practice of legal development in China. Therefore, under the vision of social transformation and order reconstruction, China should firmly adhere to the goal of legal modernization and the road of legal development pursued since the reform and opening up.
