【摘要】： 違制律,亦稱“制書有違律”,自晉代起一直在傳統(tǒng)刑法典中起到幫助法律推理的功能,同時對禮教秩序和皇權統(tǒng)治起到補充維護作用。 中國古代的服飾、發(fā)式等習俗一直是傳統(tǒng)文化的載體,屬于“禮”所規(guī)范的內(nèi)容。中國歷代王朝為鞏固自身的統(tǒng)治,曾數(shù)度頒布“易俗令”,其中尤以清代施行的剃發(fā)易服令持續(xù)最久、范圍最廣、影響最大、引發(fā)沖突最多。統(tǒng)治者將衣冠服飾等這些本用“禮”來規(guī)范的內(nèi)容,強行劃入由律令懲治的范疇,同時為避免“律無罪名”,將其統(tǒng)一納入違制律,使之成為其出“禮”入“法”的工具,為這一類的司法擅斷提供了“合法性”依據(jù)。 論文通過對“易俗令”與違制律的歷史沿革的梳理,對其歷史教訓和現(xiàn)實影響的分析比較和研究,結(jié)合時代背景和社會、經(jīng)濟、文化的發(fā)展,對其存在的合理性與制度缺陷進行初步的探討。
[Abstract]:Since the Jin Dynasty, it has been playing a role in helping the legal reasoning in the traditional criminal code, at the same time, it has played a supplementary role in maintaining the order of etiquette and the rule of imperial power. Ancient Chinese dress, hairstyle and other customs have been the carrier of traditional culture, belong to the "ritual" standard content. Chinese dynasties in order to consolidate their own rule, There have been several times of "changing customs", especially in the Qing Dynasty, where the order of shaving and changing clothes lasted the longest, most widely, had the greatest influence and caused the most conflicts. The rulers used "ritual" to regulate the dress and dress of the rulers. In order to avoid the "law not guilty", to bring it into the violation of the law, and to make it the tool of "courtesy" into "law", it provides the basis of "legality" for this kind of judicial arbitrariness. Through combing the historical evolution of "changing customs" and violating the rules of control, the paper analyzes and compares the historical lessons and the practical effects, and combines the background of the times with the development of society, economy and culture. The rationality of its existence and institutional defects are preliminarily discussed.
