【摘要】：專利制度在美國(guó)成長(zhǎng)為科技大國(guó)的過(guò)程中始終扮演著重要角色。2011年,美國(guó)迎來(lái)了自1952年建立專利制度以來(lái)的最強(qiáng)勁而全面的專利法改革。此次改革內(nèi)容寬泛,其中涉及專利申請(qǐng)與審查變化的內(nèi)容主要包括:"先申請(qǐng)"原則、"絕對(duì)"新穎性審查標(biāo)準(zhǔn)、發(fā)明內(nèi)容披露的寬限條件、授權(quán)后審查機(jī)制、國(guó)外優(yōu)先權(quán)限制、補(bǔ)充審查以及最佳實(shí)施例等七個(gè)方面。
[Abstract]:The patent system has always played an important role in the growth of the United States as a scientific and technological power. In 2011, the United States welcomed the strongest and most comprehensive patent law reform since the establishment of the patent system in 1952. The main contents involved in patent application and examination change include: "first application" principle, "absolute" novelty examination standard, lenient conditions for disclosure of invention content, post-authorization review mechanism, foreign priority restriction, Supplementary review and the best implementation of seven aspects.
