【摘要】：漢斯·凱爾森的法學(xué)理論與新康德主義哲學(xué)之間的內(nèi)在關(guān)聯(lián)已為學(xué)界所周知,但究竟是何種關(guān)聯(lián)以及如何關(guān)聯(lián)的,卻并不清晰。作為德國二戰(zhàn)前最重要的哲學(xué)思潮,新康德主義是凱爾森法學(xué)思想的靈感和基礎(chǔ)所在。無論是馬爾堡學(xué)派的先驗(yàn)認(rèn)知理論,還是西南德學(xué)派的判斷和效力學(xué)說,都為凱爾森所繼受,并納入到其法學(xué)理論大廈的建構(gòu)當(dāng)中。正是建立在這兩個(gè)學(xué)派基礎(chǔ)之上的凱爾森法學(xué)理論,為法學(xué)成為一門科學(xué)奠定了幾乎所有重要的概念。這些新康德主義要素就此成為凱爾森法學(xué)乃至法哲學(xué)思想研究必要的對(duì)象。然而,凱爾森自己卻幾乎沒有專門論述過新康德主義思想。通過調(diào)查,本文不僅揭示兩者之間的關(guān)聯(lián),也試圖間接為我國學(xué)者建構(gòu)中國自身的法學(xué)理論提供某些有益的啟示。
[Abstract]:The inner link between Hans-Carlson 's theory of law and Neo-Kantian philosophy is well known, but it's not clear what and how it is. It's the most important philosophical trend before World War II in Germany. Neo-Kantianism is the inspiration and foundation of Kelsen's legal thought. Whether it is the transcendental cognitive theory of Marburg school or the judgment and validity theory of southwest German school, Kelsen inherited it. And into the construction of his legal theory edifice. It is on the basis of these two schools that Kelsen's theory of law is built. Almost all the important concepts have been laid for the law to become a science. These Neo-Kantian elements have thus become the necessary objects for the study of Kelsen's philosophy of law and even the philosophy of law. Through investigation, this paper not only reveals the relationship between the two, but also attempts to provide some beneficial enlightenment for Chinese scholars to construct their own legal theory.
