【摘要】：當(dāng)下的中國(guó)法學(xué)正面臨嚴(yán)重的文化"認(rèn)同危機(jī)",即中國(guó)法學(xué)受到"西方現(xiàn)代化范式"的支配。實(shí)現(xiàn)真正的法學(xué)"中國(guó)化",應(yīng)當(dāng)融匯西方、傳統(tǒng)和社會(huì)主義三種因素,并實(shí)現(xiàn)某種超越。建構(gòu)中國(guó)自身的法律理想圖景,應(yīng)重視對(duì)儒家文化傳統(tǒng)中"民本""仁"和"孝"的轉(zhuǎn)出和提煉。
[Abstract]:The present Chinese jurisprudence is facing a serious cultural "identity crisis", that is, the Chinese jurisprudence is dominated by the "western modernization paradigm". To realize the true "Sinicization" of Chinese jurisprudence, it is necessary to integrate the western, traditional and socialist factors. In order to construct the legal ideal prospect of China itself, we should pay attention to the transfer and refinement of "people-oriented" "benevolence" and "filial piety" in the Confucian cultural tradition.
