【摘要】：從2003年試點至今,再犯率被作為社區(qū)矯正效果評價的主要衡量標準,我國社區(qū)矯正在控制再犯率這一問題上成果顯著。在這樣的背景下,本文在實地調(diào)研的基礎(chǔ)上,以社區(qū)矯正中再犯率的概念更新問題為研究切入點,分析我國社區(qū)矯正效果評價體系存在的不足,通過對照社區(qū)矯正實踐對再犯率概念的內(nèi)涵和外延進行更新,為完善社區(qū)矯正效果評價體系的針對性和可操作性,進行有益的嘗試。著眼于社區(qū)矯正的實際工作,為了更好地揭示社區(qū)矯正工作的重點與趨勢,促進司法社會工作與社區(qū)矯正更好地共生發(fā)展,更好地完善社區(qū)矯正效果評價體系,將社區(qū)矯正中的再犯率概念更新細化為:宏觀層面的自然再犯率與矯正再犯率,以及微觀層面的刑期內(nèi)再犯率與刑期后再犯率。在此基礎(chǔ)上,強調(diào)司法社會工作者在社區(qū)矯正人才隊伍建設(shè)方面的重要性,希望構(gòu)建出具有良性現(xiàn)實導(dǎo)向的社區(qū)矯正效果評價體系。本文主要從三個方面進行分析:第一,社區(qū)矯正效果評價體系應(yīng)具有怎樣的內(nèi)涵?第二,社區(qū)矯正效果評價體系的現(xiàn)狀、問題以及背后原因是什么?第三,如何通過再犯率概念的更新去完善社區(qū)矯正效果評價體系?從引言、社區(qū)矯正效果評價體系概述、社區(qū)矯正效果評價的現(xiàn)狀與問題、社區(qū)矯正中再犯罪率概念的更新、社區(qū)矯正效果評價體系的構(gòu)建與完善等部分展開論述。
[Abstract]:Since the trial in 2003, the reoffending rate has been regarded as the main criterion for evaluating the effect of community correction, and the community correction in our country has achieved remarkable results in controlling the recurrence rate. In this context, on the basis of on-the-spot investigation, this paper analyzes the shortcomings of the evaluation system of community correction effect based on the renewal of the concept of reoffending rate in community correction. In order to improve the pertinence and maneuverability of the evaluation system of community correction effect, the connotation and extension of the concept of recidivism rate are updated according to the practice of community correction. Focusing on the practical work of community correction, in order to better reveal the focus and trend of community correction work, promote the judicial social work and community correction better symbiotic development, better improve the evaluation system of community correction effect, The concept of reoffending rate in community correction is updated and refined as follows: natural recidivism rate and corrected reoffending rate in macro-level, re-offending rate in prison term in microcosmic level and reoffending rate after sentence. On this basis, it emphasizes the importance of judicial social workers in the construction of community correction talent team, and hopes to construct a community correction effect evaluation system with benign reality orientation. This article mainly carries on the analysis from three aspects: first, what kind of connotation should the community correction effect evaluation system have? Second, the status quo of the evaluation system of community correction effect, the problems and the reasons behind it? Thirdly, how to perfect the evaluation system of community correction effect through the renewal of the concept of reoffending rate? From the preface, the summary of community correction effect evaluation system, the present situation and problems of community correction effect evaluation, the renewal of the concept of re-crime rate in community correction, the construction and perfection of community correction effect evaluation system, etc.
