【摘要】：第三次科技革命帶來了信息技術(shù)的高速發(fā)展,人類社會(huì)從工業(yè)時(shí)代步入信息化、知識(shí)化時(shí)代,網(wǎng)絡(luò)也應(yīng)運(yùn)而生。正如硬幣的兩面性一樣,一方面,互聯(lián)網(wǎng)以其獨(dú)有的特質(zhì)拉近了世界各國的距離,促進(jìn)了不同國家地區(qū)人們之間的政治、經(jīng)濟(jì)和文化交流,改變了人們?cè)械纳罘绞�、生產(chǎn)方式。另一方面,它在帶給人們便捷的同時(shí),又引發(fā)出一系列嚴(yán)重的社會(huì)問題,比如網(wǎng)絡(luò)違法犯罪等。近年來,網(wǎng)絡(luò)犯罪的嚴(yán)重危害性已引起各國的高度重視,預(yù)防和打擊與日俱增的網(wǎng)絡(luò)違法犯罪,己成為各國政府面臨的嚴(yán)峻挑戰(zhàn)和現(xiàn)代犯罪對(duì)策研究的新課題。 由于青少年學(xué)生是網(wǎng)民所占比重最大的群體,學(xué)生網(wǎng)絡(luò)犯罪伴隨著信息化的快速發(fā)展和科技化手段的普及而在學(xué)生群體中迅速蔓延,成為網(wǎng)絡(luò)犯罪中的一種新的態(tài)勢(shì)。在我國,隨著我國信息化社會(huì)建設(shè)進(jìn)程的加快,青少年學(xué)生犯罪問題日益突出,嚴(yán)重地影響了和諧社會(huì)的構(gòu)建及學(xué)生的健康成長(zhǎng)。為了促進(jìn)社會(huì)的和諧和可持續(xù)發(fā)展,遏制學(xué)生網(wǎng)絡(luò)犯罪高發(fā)態(tài)勢(shì),研究學(xué)生網(wǎng)絡(luò)犯罪的原因與預(yù)防對(duì)策,已經(jīng)刻不容緩。 本文基于以上分析,立足于社會(huì)學(xué)角度,綜合運(yùn)用多學(xué)科研究法、比較分析法、理論聯(lián)系實(shí)際法、文獻(xiàn)研究法等研究方法和治理理論這一理論工具,對(duì)我國學(xué)生網(wǎng)絡(luò)犯罪的現(xiàn)狀及其預(yù)防這一論題進(jìn)行了深入探討。文章首先對(duì)我國青少年學(xué)生網(wǎng)絡(luò)犯罪的相關(guān)理論進(jìn)行了簡(jiǎn)要闡述,在對(duì)學(xué)生網(wǎng)絡(luò)犯罪涵義進(jìn)行科學(xué)界定的基礎(chǔ)上,分析了我國預(yù)防青少年學(xué)生網(wǎng)絡(luò)犯罪的必要性,強(qiáng)調(diào)預(yù)防青少年學(xué)生網(wǎng)絡(luò)犯罪是維護(hù)網(wǎng)絡(luò)安全、保障青少年學(xué)生健康成長(zhǎng)、維護(hù)社會(huì)安定和經(jīng)濟(jì)運(yùn)行秩序的必然要求。其后又進(jìn)一步分析我國青少年學(xué)生網(wǎng)絡(luò)犯罪的現(xiàn)狀和成因,認(rèn)為我國學(xué)生網(wǎng)絡(luò)犯罪存在低齡化、增幅迅猛、犯罪主體多元化以及利用網(wǎng)絡(luò)制作、傳播色情、淫穢物品的案件十分突出等新動(dòng)向,這些問題的存在是政治、法制、社會(huì)、經(jīng)濟(jì)和學(xué)生自身觀念等多個(gè)因素共同作用的后果。最后,本文在介紹國外預(yù)防學(xué)生網(wǎng)絡(luò)犯罪的經(jīng)驗(yàn)的基礎(chǔ)上提出了我國預(yù)防青少年學(xué)生網(wǎng)絡(luò)犯罪的對(duì)策,包括加強(qiáng)法制防控、加強(qiáng)社會(huì)防控、加強(qiáng)教育防控、加強(qiáng)技術(shù)防控等四個(gè)方面。在當(dāng)前我國學(xué)生網(wǎng)絡(luò)犯罪形勢(shì)日益嚴(yán)峻的情況下,本文的研究將為促進(jìn)網(wǎng)絡(luò)社會(huì)的健康有序運(yùn)行和防治學(xué)生網(wǎng)絡(luò)犯罪提供了有益的理論借鑒和實(shí)踐參考。
[Abstract]:The third revolution of science and technology brought the rapid development of information technology, and the human society stepped into information technology from the industrial age, and the network also came into being in the age of knowledge. Just like the two sides of the coin, on the one hand, the Internet, with its unique characteristics, has brought countries closer, promoted political, economic and cultural exchanges among people in different countries and regions, and changed people's original way of life. Mode of production. On the other hand, it not only brings people convenience, but also causes a series of serious social problems, such as network crime. In recent years, the serious harmfulness of cybercrime has aroused great attention of all countries. Preventing and cracking down on the increasing number of cyber crimes has become a serious challenge facing governments and a new subject for the study of modern crime countermeasures. With the rapid development of information technology and the popularization of scientific and technological means, students' network crime has become a new trend in the network crime. In China, with the acceleration of the construction process of our country's information society, the problem of juvenile delinquency has become increasingly prominent, which has seriously affected the construction of a harmonious society and the healthy growth of students. In order to promote the harmonious and sustainable development of the society and curb the high incidence of students' cybercrime, it is urgent to study the causes and preventive measures of students' cybercrime. Based on the above analysis, based on the sociological perspective, this paper synthetically uses multi-disciplinary research method, comparative analysis method, theoretical and practical method, literature research method and governance theory as a theoretical tool. This paper probes into the status quo and prevention of students' cyber crime in China. Firstly, this paper briefly expounds the related theories of juvenile students' cybercrime in our country. On the basis of scientifically defining the meaning of students' cybercrime, it analyzes the necessity of preventing juvenile students' cybercrime in our country. It is emphasized that the prevention of juvenile students' network crime is an inevitable requirement for safeguarding the network security, safeguarding the healthy growth of young students, and maintaining social stability and economic operation order. Then it further analyzes the present situation and causes of juvenile students' cybercrime in our country, and points out that there is a younger age, a rapid increase in the number of criminal subjects, and the use of network production to spread pornography in our country. The cases of obscene objects are very prominent and so on. The existence of these problems is the result of the joint action of many factors, such as politics, legal system, society, economy and students' own ideas. Finally, on the basis of introducing the experiences of foreign countries in preventing students' cybercrime, this paper puts forward the countermeasures of preventing juvenile students' cybercrime in our country, including strengthening legal prevention and control, strengthening social prevention and control, strengthening education prevention and control. Strengthen technical prevention and control and other four aspects. With the increasingly serious situation of students' network crime in our country, the research in this paper will provide a useful theoretical and practical reference for promoting the healthy and orderly operation of the network society and preventing and controlling students' network crime.
