【摘要】：犯罪人作為傳統(tǒng)的犯罪學(xué)研究重心,受到了學(xué)界長(zhǎng)期的關(guān)注,其對(duì)立面——被害人的研究卻總被忽視。但事實(shí)上,犯罪與被害是一個(gè)問(wèn)題的兩個(gè)方面,不可割離,有時(shí)甚至互為因果。被害人本身具有的被害性,起著誘發(fā)、刺激犯罪動(dòng)機(jī),提供犯罪實(shí)施便利條件,降低犯罪風(fēng)險(xiǎn)或者輔助犯罪發(fā)生的作用,將犯罪被害人以及被害性問(wèn)題的研究列為犯罪研究的重要組成部分,對(duì)犯罪預(yù)防控制具有極其重要的意義。本文在系統(tǒng)研究了寧波市鎮(zhèn)海區(qū)近五年(2011年-2015年)發(fā)生的2079起傷害案件的基礎(chǔ)上,探討傷害犯罪中被害人與犯罪的辯證關(guān)系,著重對(duì)傷害犯罪被害人過(guò)錯(cuò)的類型、特征進(jìn)行考察,總結(jié)出被害人本身具有的傾向性、易感性、誘發(fā)性、受容性等特征,以達(dá)到減弱或者消除犯罪被害人的被害性的目的,從社會(huì)層面、社區(qū)層面、個(gè)體層面三個(gè)方面提出了分層構(gòu)建被害預(yù)防體系,進(jìn)而針對(duì)性地開(kāi)展傷害犯罪被害預(yù)防,促進(jìn)社會(huì)治安穩(wěn)定。
[Abstract]:As the focus of traditional criminology, the criminal has been paid attention to for a long time, but the research of the victim is always ignored. But in fact, crime and victimization are two aspects of the same problem, can not be cut off, sometimes even cause and effect each other. The victimization of the victim itself plays the role of inducing, stimulating the motive of the crime, providing convenient conditions for the implementation of the crime, reducing the risk of the crime or assisting the occurrence of the crime, It is of great significance for crime prevention and control to make the study of crime victims and victimization as an important part of crime research. Based on the systematic study of 2079 injury cases in Zhenhai District of Ningbo City in recent five years (2011-2015), this paper discusses the dialectical relationship between the victim and the crime in the crime of injury, and focuses on the types of fault of the victim of the crime. The characteristics of the victims themselves are summarized, such as tendency, susceptibility, inducement, tolerance and so on, in order to reduce or eliminate the victimization of the victims of crime, from the social level, the community level, In the three aspects of individual level, the author puts forward to construct the system of prevention of victimization in order to carry out the prevention of victimization of crime and promote the stability of public order.
