【摘要】：公安機(jī)關(guān)偵查部門是與未成年違法犯罪人員打交道的首要關(guān)口,公安機(jī)關(guān)偵查人員在案件辦理過(guò)程中采取的手段、方式和方法,對(duì)未成年違法犯罪人員今后發(fā)展有著重要的影響。隨著我國(guó)國(guó)際地位的逐步上升,特別是《公民權(quán)利和政治權(quán)利國(guó)際公約》的批準(zhǔn),我國(guó)公安機(jī)關(guān)偵查部門及人員如何在今后執(zhí)法中遵循國(guó)際刑事司法準(zhǔn)則有關(guān)未成年人案件偵查的規(guī)定,不僅會(huì)影響我國(guó)在國(guó)際社會(huì)的聲譽(yù),而且也將對(duì)未成年人案件處理效果起到重要的作用。本文擬在分析國(guó)際刑事司法準(zhǔn)則有關(guān)未成年人案件偵查規(guī)定的基礎(chǔ)上,針對(duì)我國(guó)目前在未成年人案件偵查過(guò)程中存在的不足,提出相應(yīng)的對(duì)策,供有關(guān)部門及人員參考。
[Abstract]:The investigative department of the public security organ is the primary gateway for dealing with juvenile delinquents, and the means, methods and methods adopted by the investigators of the public security organs in the course of handling the cases, It will have an important impact on the development of juvenile delinquents in the future. With the gradual rise of our international status, in particular the ratification of the International Covenant on Civil and political Rights, How the investigation departments and personnel of our public security organs follow the provisions of the international criminal justice standards on the investigation of juvenile cases in the future will not only affect the reputation of our country in the international community, And will also play an important role in dealing with minor cases. Based on the analysis of the relevant provisions of the international criminal justice standards on the investigation of minors' cases, this paper puts forward the corresponding countermeasures for the reference of relevant departments and personnel in view of the shortcomings existing in the investigation of minors' cases in our country at present.
