【摘要】：我國(guó)司法鑒定體制改革是自下而上地逐步推行的,各地司法鑒定地方立法,在國(guó)家司法鑒定制度的逐步完善中發(fā)揮了積極的作用。重慶市人大常委會(huì)在全國(guó)人大常委會(huì)頒布《關(guān)于司法鑒定管理問(wèn)題的決定》的推動(dòng)下,于2007年11月23日,在全國(guó)率先修訂了司法鑒定的地方性法規(guī)《重慶市司法鑒定條例》。司法部司法鑒定管理局給予了高度的肯定和評(píng)價(jià),認(rèn)為該《條例"》會(huì)對(duì)各地司法鑒定法制建設(shè)產(chǎn)生積極的影響"。本文主要談一些就《條例》修訂中的做法和體會(huì),為進(jìn)一步加強(qiáng)司法鑒定地方立法拋磚引玉。
[Abstract]:The reform of judicial expertise system in our country is carried out from the bottom up step by step. The local legislation of judicial expertise in various places has played an active role in the gradual improvement of the national judicial expertise system. On November 23, 2007, the standing Committee of Chongqing Municipal people's Congress, driven by the promulgation of the decision on the Administration of Forensic expertise by the standing Committee of the National people's Congress, took the lead in revising the local regulations of Chongqing Municipality on Forensic expertise in the whole country. The Judicial Appraisal Administration of the Ministry of Justice has highly affirmed and appraised that the regulations will have a positive impact on the construction of the legal system of judicial expertise in various places. This article mainly talks about some practices and experiences in the revision of the regulations, which will serve as a reference for further strengthening the local legislation on judicial expertise.
