【摘要】：隨著社會(huì)的發(fā)展,時(shí)代的驟進(jìn),科技的飛躍,犯罪行為形態(tài)也呈現(xiàn)出新的特點(diǎn),對(duì)刑事偵查破案工作提出了更高層次的理論和實(shí)踐的要求。在與犯罪分子的博弈中,DNA技術(shù)在偵查上的運(yùn)用和拓展、視頻偵查技術(shù)的應(yīng)用和線索挖掘、通訊電磁痕跡的整理分析串并比對(duì)、信息資源的整合共享應(yīng)用都為刑事偵查破案拓展了渠道,讓傳統(tǒng)的刑事偵查煥發(fā)了新的色彩,推動(dòng)了偵查工作的更新升級(jí),讓社會(huì)共建共享的理念在刑事偵查中得以充分的體現(xiàn)。現(xiàn)代刑事科學(xué)技術(shù)是運(yùn)用自然科學(xué)和社會(huì)科學(xué)的原理及方法在同刑事犯罪斗爭中揭露、證實(shí)和預(yù)防犯罪的一切技術(shù)手段和方法的總稱,是一門涉及多學(xué)科的綜合性應(yīng)用科學(xué)。其狹義的的內(nèi)容范籌包括現(xiàn)場勘察、取證、各種痕跡、文件物證檢驗(yàn)、毒物、毒品檢驗(yàn)、法醫(yī)學(xué)、尸體檢驗(yàn)和臨床試驗(yàn)以及精神病學(xué)鑒定;廣義的內(nèi)容范籌還包括在案件偵查和調(diào)查過程中、在犯罪預(yù)防中運(yùn)用的科學(xué)技術(shù)。通過查閱大量文獻(xiàn)資料及教科書,發(fā)現(xiàn)目前現(xiàn)代刑事科學(xué)技術(shù)學(xué)科主要還是研究狹義的刑事科學(xué)技術(shù),主要對(duì)公安司法鑒定起到理論支撐和幫助。在刑事偵查方面,也就是現(xiàn)代刑事科學(xué)技術(shù)廣義的外沿部分,近年來,越來越多的學(xué)者和一線偵查員開始關(guān)注并研究。刑事科學(xué)技術(shù)是科技強(qiáng)警的新興工具,在犯罪偵查中,對(duì)更新傳統(tǒng)觀念,爭取辦案實(shí)效,改進(jìn)偵破方法,提高人員素質(zhì)等均有顯著作用。偵查破案需要刑事偵查中的科學(xué)技術(shù)的協(xié)助,現(xiàn)代科學(xué)技術(shù)的理論和成果也是發(fā)現(xiàn)和獲取破案關(guān)鍵線索、證據(jù)的各種技術(shù)手段和技術(shù)方法的總和,同時(shí)對(duì)提高打擊犯罪的預(yù)警能力具有重要作用。它既包括現(xiàn)代化的技術(shù)裝備,也包括現(xiàn)代化的偵查觀念,同時(shí)要求工作人員的整體科技素質(zhì)的提高。論文擬通過結(jié)合工作中的刑事案件偵破案例,探索新形勢下如何運(yùn)用DNA技術(shù)、視頻偵查技術(shù)、通訊電磁痕跡、信息資源整合共享等現(xiàn)代科學(xué)技術(shù),改進(jìn)傳統(tǒng)偵破方法,提高刑事案件偵破效率。
[Abstract]:With the development of society, the rapid development of the times, the leap of science and technology, the form of criminal behavior also presents new characteristics, which puts forward a higher level of theoretical and practical requirements for the work of criminal investigation and detection. In the game with criminals, the application and expansion of DNA technology in investigation, the application of video detection technology and the mining of clues, the collation and analysis of electromagnetic traces of communication, The integration and sharing of information resources have opened up channels for criminal investigation, made the traditional criminal investigation glow with new colors, and promoted the updating and upgrading of the investigation work. The concept of social co-construction and sharing can be fully reflected in criminal investigation. Modern criminal science and technology is a general term of all technical means and methods to expose, prove and prevent crime by applying the principles and methods of natural science and social science in the struggle against criminal offenses. It is a comprehensive applied science involving many disciplines. Its narrow content includes field investigation, evidence collection, various traces, documentary evidence examination, poison, drug examination, forensic medicine, cadaver examination and clinical trial, as well as psychiatry identification; The broad content also includes the science and technology used in the investigation and investigation of cases and crime prevention. By consulting a large number of documents and textbooks, it is found that at present, the subject of modern criminal science and technology is mainly devoted to the study of narrow sense criminal science and technology, which mainly supports and helps the judicial identification of public security. In the aspect of criminal investigation, which is the outer part of the broad sense of modern criminal science and technology, in recent years, more and more scholars and front-line investigators begin to pay attention to and study. Criminal science and technology is a new tool for strengthening the police by science and technology. In the investigation of crimes, it has a remarkable effect on renewing the traditional concept, striving for the actual results of handling cases, improving the methods of detection and improving the quality of personnel, etc. Investigating and solving cases need the assistance of science and technology in criminal investigation. The theories and achievements of modern science and technology are also the summation of the key clues of finding and obtaining the case, the technical means and methods of evidence, At the same time, it plays an important role in improving the ability of early warning against crime. It includes not only modern technical equipment, but also modern concept of investigation, at the same time, it requires the improvement of the overall scientific and technological quality of the staff. This paper attempts to explore how to use modern science and technology, such as DNA technology, video detection technology, communication electromagnetic trace, information resources integration and sharing, to improve the traditional detection methods in the new situation by combining the criminal case detection cases in the work.
