【摘要】： 我國(guó)大陸與臺(tái)灣地區(qū)雖然同屬大陸法系,但在刑事鑒定人制度方面存在諸多區(qū)別。本文從自然人鑒定人的資格和條件、鑒定人的選任、鑒定人的權(quán)利和義務(wù)、鑒定人的法律責(zé)任、鑒定人的回避方面對(duì)海峽兩岸刑事鑒定人制度進(jìn)行簡(jiǎn)要比較,在此基礎(chǔ)上,就海峽兩岸刑事鑒定人制度目前存在的一些不足與亟待解決的問題進(jìn)行分析,并在鑒定人出庭作證、鑒定人的人身保護(hù)、鑒定人的回避方面提出了自己的觀點(diǎn),以期鑒定人制度的進(jìn)一步發(fā)展與完善。
[Abstract]:Although the mainland and Taiwan belong to the civil law system, there are many differences in the criminal identification system. This paper briefly compares the two sides of the Taiwan Strait criminal expert system from the aspects of the qualifications and conditions of natural person experts, the selection of experts, the rights and obligations of experts, the legal responsibilities of experts, and the avoidance of experts. This paper analyzes some shortcomings of the current system of criminal appraisers on both sides of the Taiwan Strait and the problems to be solved urgently, and puts forward its own views on the witnesses appearing in court, the habeas corpus of experts, and the avoidance of connoisseurs. With a view to the further development and improvement of the expert system.
