【摘要】：犯罪學(xué)這門橫跨自然科學(xué)和社會科學(xué)兩大領(lǐng)域的百科知識式的學(xué)科,在性質(zhì)上屬于社會醫(yī)學(xué),這一命題是理解犯罪學(xué)學(xué)科性質(zhì)的新思路,是犯罪學(xué)理論研究走出迷思的途徑。以"除惡防害"宗旨服務(wù)于社會的犯罪學(xué)理論和以"除病消災(zāi)"為宗旨服務(wù)于人類的醫(yī)學(xué)具有相同的思維模式,這是理解犯罪學(xué)在學(xué)科性質(zhì)上屬于社會醫(yī)學(xué)的主要根據(jù)之一。將犯罪問題看成社會疾病,原本就是犯罪學(xué)和社會學(xué)產(chǎn)生以來就有的思想,但由于傳統(tǒng)的思維定式和刑法學(xué)理論的強勢地位,導(dǎo)致犯罪學(xué)理論淪為刑事科學(xué)的附庸。因此,它的這一閃光思想未能使刑罰主義在治理犯罪的實踐中讓位于醫(yī)學(xué)模式,從而形成了犯罪學(xué)理論愈發(fā)達(dá),犯罪現(xiàn)象愈嚴(yán)重的奇怪現(xiàn)象,這說明犯罪學(xué)理論還未達(dá)到應(yīng)有的科學(xué)程度和影響顯著的社會地位。因此,需要依據(jù)犯罪學(xué)的性質(zhì)要求進(jìn)行變革,以充分發(fā)揮其效能和取得醫(yī)治犯罪的理論主導(dǎo)地位并服務(wù)于社會。犯罪學(xué)理論和學(xué)科,既然屬于醫(yī)治社會疾病的理論和學(xué)科,那么,它對于專事處理"犯罪"這一社會病患的刑事法律制度的建立和改革,必然起積極的推動作用。
[Abstract]:Criminology, an encyclopedic discipline spanning two major fields of natural science and social science, belongs to social medicine in nature. This proposition is a new way to understand the nature of criminology and a way for theoretical research of criminology to get out of the puzzle. The theory of criminology serving society with the aim of "eliminating evil and preventing harm" and the medical science serving human beings with the purpose of "eliminating diseases and eliminating disasters" have the same thinking mode, which is one of the main bases for understanding that criminology belongs to social medicine in nature of discipline. Since the emergence of criminology and sociology, the problem of crime is regarded as a social disease. However, due to the traditional thinking pattern and the strong position of criminal law theory, criminology theory is reduced to the vassal of criminal science. Therefore, its flash of thought failed to give way to the medical model in the practice of penalism in the practice of crime control, thus forming a strange phenomenon in which the criminology theory became more and more common, and the crime phenomenon became more serious. This shows that the criminological theory has not yet reached its due scientific level and significant social status. Therefore, it is necessary to make changes according to the nature of criminology in order to give full play to its effectiveness and obtain the dominant position of the theory of treating crime and serve the society. The theory and discipline of criminology, since it belongs to the theory and discipline of treating social diseases, must play a positive role in the establishment and reform of the criminal legal system of dealing with "crime" as a social patient.
