【摘要】：網(wǎng)絡(luò)舉報(bào)是科技發(fā)展與民主政治有機(jī)融合的結(jié)果,為改革開(kāi)放和人民權(quán)益的實(shí)現(xiàn)開(kāi)闊了一個(gè)廣泛的平臺(tái),網(wǎng)絡(luò)舉報(bào)事件的頻發(fā)顯示出政府與民間懲治違法犯罪力量的不斷增強(qiáng)。但正是由于網(wǎng)絡(luò)獨(dú)特性和網(wǎng)絡(luò)舉報(bào)中彰顯出來(lái)的獨(dú)特的魅力,也刺激了以此作為手段的違法犯罪行為的增加,網(wǎng)絡(luò)舉報(bào)的產(chǎn)生和發(fā)展,由此滋生了一系列相關(guān)法律問(wèn)題爭(zhēng)議,對(duì)誹謗、誣告陷害等罪名的誤讀,對(duì)網(wǎng)絡(luò)舉報(bào)權(quán)力的濫用,對(duì)網(wǎng)絡(luò)舉報(bào)中所產(chǎn)生責(zé)任的錯(cuò)判,這些問(wèn)題的存在無(wú)不對(duì)網(wǎng)絡(luò)舉報(bào)行為的法律體制提出了新的要求。在網(wǎng)絡(luò)舉報(bào)中行使正當(dāng)合法的權(quán)力時(shí),既要考慮保護(hù)自身的權(quán)利不受侵犯,又要考慮哪些行為侵犯了他人合法權(quán)益,導(dǎo)致違法犯罪行為。對(duì)這些問(wèn)題的探討,首當(dāng)其沖的就是涉及到關(guān)于刑法的法益保護(hù)、刑法的科學(xué)性與合理性、法治和人權(quán)的保護(hù)問(wèn)題,因此其研究意義是非常重要的；其次,信息化時(shí)代的到來(lái)也給予了網(wǎng)絡(luò)舉報(bào)巨大的發(fā)展空間,從網(wǎng)絡(luò)中舉報(bào)的案件頻頻發(fā)生,幾乎導(dǎo)致網(wǎng)絡(luò)舉報(bào)運(yùn)行的癱瘓,在這種危機(jī)下,民間舉報(bào)網(wǎng)也頻頻開(kāi)始運(yùn)作起來(lái),于是,網(wǎng)絡(luò)舉報(bào)的維權(quán)與由此引發(fā)的違法犯罪行為便悄然誕生。基于此,對(duì)我國(guó)網(wǎng)絡(luò)舉報(bào)的進(jìn)展情況與現(xiàn)存的問(wèn)題就要做一個(gè)整體的分析,并從客觀方面和主觀方面的原因分析我國(guó)網(wǎng)絡(luò)舉報(bào)所引發(fā)犯罪的深層次原因,從而為網(wǎng)絡(luò)舉報(bào)的概念作出界定；再次,網(wǎng)絡(luò)舉報(bào)作為一種新的舉報(bào)方式畢竟和傳統(tǒng)舉報(bào)方式有著大量不同的特征,其科技性、廣泛傳播性、信息安全的不穩(wěn)定性已對(duì)對(duì)其引發(fā)犯罪的類(lèi)型和犯罪的特征提出了新的要求,因此有必要從刑法學(xué)意義上,對(duì)其引發(fā)犯罪的類(lèi)型和犯罪的特征的作出分析,指出其引發(fā)犯罪的相關(guān)罪名界定的原則；那么,如何保障舉報(bào)人的權(quán)益不受侵犯,舉報(bào)人在何種情形下刑法才會(huì)介入,引發(fā)犯罪的發(fā)生,建立一種什么機(jī)制才能保障網(wǎng)絡(luò)舉報(bào)才能在危機(jī)中渡過(guò)難關(guān),使其長(zhǎng)效發(fā)展,永葆生機(jī)將是最后闡述的：通過(guò)對(duì)舉報(bào)人的保護(hù)、網(wǎng)絡(luò)舉報(bào)行為的法律規(guī)制以及健全網(wǎng)絡(luò)舉報(bào)制度的三個(gè)方面的視角來(lái)完善我國(guó)網(wǎng)絡(luò)舉報(bào)制度。
[Abstract]:Network reporting is the result of the organic integration of scientific and technological development and democratic politics, which opens up a wide platform for the realization of reform and opening up and the realization of people's rights and interests. The frequent occurrence of network reporting shows the increasing strength of the government and the folk in punishing illegal and criminal activities. However, it is precisely because of the uniqueness of the network and the unique charm of the network reporting that it also stimulates the increase of illegal and criminal acts as a means, and the emergence and development of the network reporting, which breeds a series of disputes on related legal issues. The misreading of libel, falsehood and so on, the abuse of network reporting power, and the misjudgment of responsibility arising from network reporting, all of these problems put forward new requirements to the legal system of network reporting. In the exercise of legitimate and legitimate rights in network reporting, we should not only consider protecting our own rights from infringement, but also consider which acts infringe upon the legitimate rights and interests of others, leading to illegal and criminal acts. The discussion of these problems is related to the protection of legal interests of criminal law, the scientific and reasonable nature of criminal law, the protection of the rule of law and human rights, so its research significance is very important. The arrival of the information age also gives a huge space for the development of network reporting. Cases reported from the network occur frequently, almost leading to the paralysis of the network reporting operation. Under this crisis, the folk reporting network also frequently starts to operate, so, The rights protection of network report and the illegal and criminal behavior caused by it are born quietly. Based on this, we should make an overall analysis of the progress and existing problems of our country's network reporting, and analyze the deep-seated causes of the crimes caused by the network reporting in our country from the objective and subjective aspects. In order to define the concept of network reporting; thirdly, as a new way of reporting, network report has a lot of different characteristics from the traditional way of reporting, its science and technology, widespread dissemination, The instability of information security has put forward new requirements on the types and characteristics of crimes caused by them, so it is necessary to analyze the types and characteristics of crimes caused by them in the sense of criminal law. Then, how to protect the rights and interests of the whistleblower is not infringed, and under what circumstances will the whistleblower intervene in the criminal law, which will lead to the occurrence of the crime, the author points out the principle of the definition of the relevant crime, and how to protect the rights and interests of the whistleblower. The establishment of a mechanism to ensure that network reporting can tide over the crisis and enable it to develop effectively will be the last elaboration: through the protection of whistleblowers, In order to perfect our country's network reporting system, the legal regulation of network reporting behavior and the three aspects of perfecting network reporting system are discussed.
