【摘要】：司法實踐中,由瑕疵出資引發(fā)的瑕疵股權轉(zhuǎn)讓問題較為常見,相應瑕疵出資責任的承擔問題引起糾紛不斷,本文在對浙江某公司瑕疵出資股權轉(zhuǎn)讓司法會計鑒定案例解析的基礎上,分析了相關的司法會計鑒定及股權轉(zhuǎn)讓的責任承擔問題。
[Abstract]:In judicial practice, the problem of the transfer of defective shares caused by defective capital contribution is common, and the corresponding problem of bearing the responsibility of defective capital contribution causes disputes. On the basis of the analysis of the case of judicial accounting for the transfer of defective capital shares in a company in Zhejiang Province, this paper analyzes the related problems of judicial accounting identification and the responsibility of equity transfer.
