【摘要】： 網(wǎng)絡(luò)虛擬財(cái)產(chǎn)是隨著網(wǎng)絡(luò)技術(shù)的發(fā)展出現(xiàn)的一種新興的社會現(xiàn)象和事物,在我國由于在理論界和司法實(shí)踐中對其基本的特征和法律屬性的認(rèn)識存在分歧,在我國現(xiàn)行的法律上對網(wǎng)絡(luò)虛擬財(cái)產(chǎn)的規(guī)制還相對處于空白的真空狀態(tài),進(jìn)而導(dǎo)致了法律界針對網(wǎng)絡(luò)虛擬財(cái)產(chǎn)個案的法律適用、與學(xué)術(shù)觀點(diǎn)上的爭議,凸現(xiàn)了法律的滯后性。筆者試圖在借鑒相關(guān)研究成果的基礎(chǔ)上,結(jié)合現(xiàn)實(shí)中大大量案例進(jìn)行分析研究,確認(rèn)了其債權(quán)的本質(zhì)屬性,同時總結(jié)并歸納出網(wǎng)絡(luò)虛擬財(cái)產(chǎn)權(quán)區(qū)別于其他財(cái)產(chǎn)權(quán)的特征,明確了其虛擬性、價值性、可轉(zhuǎn)讓性以及限制性等特點(diǎn),力求將其納入到我國現(xiàn)行刑法體系中予以保護(hù)。同時,在分析網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪現(xiàn)狀的基礎(chǔ)上,通過與傳統(tǒng)侵犯財(cái)產(chǎn)犯罪在犯罪構(gòu)成上進(jìn)行比較,指出網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪是一種新型的犯罪模式,通過論證其犯罪的危害性、社會性,突出對網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪進(jìn)行刑法保護(hù)的重要性和適當(dāng)性。針對網(wǎng)絡(luò)虛擬財(cái)產(chǎn)的特點(diǎn)以及常見糾紛形式,參考網(wǎng)絡(luò)游戲產(chǎn)業(yè)運(yùn)營模式和國外的立法經(jīng)驗(yàn),最終建議確立規(guī)制虛擬財(cái)產(chǎn)犯罪的刑法體系,以促進(jìn)我國網(wǎng)絡(luò)游戲產(chǎn)業(yè)的持續(xù)發(fā)展和保障經(jīng)濟(jì)社會的健康有序前進(jìn),為網(wǎng)絡(luò)虛擬財(cái)產(chǎn)犯罪相關(guān)的立法與司法實(shí)踐提供借鑒作用。
[Abstract]:With the development of network technology, virtual property is a new kind of social phenomenon and thing. In our country, there are different views on its basic characteristics and legal attributes in theory and judicial practice. The regulation of network virtual property in the current law of our country is still relatively blank, which leads to the legal application of network virtual property cases, and disputes with the academic point of view, highlighting the lag of law. Based on the relevant research results, the author tries to analyze and study a large number of real cases, confirm the nature of the creditor's rights, and sum up the characteristics of the network virtual property rights which are different from other property rights. This paper clarifies its fictitious, value, transferable and restrictive characteristics, and tries to bring them into the current criminal law system of our country to protect them. At the same time, on the basis of analyzing the present situation of the crime of network virtual property, by comparing with the traditional crime of infringing property, the author points out that the crime of network virtual property is a new type of crime pattern, and proves the harmfulness of the crime. Sociality, emphasize the importance and appropriateness of criminal law protection to network virtual property crime. According to the characteristics of network virtual property and the common forms of disputes, referring to the operation mode of online game industry and the legislative experience of foreign countries, the final suggestion is to establish the criminal law system to regulate the crime of virtual property. In order to promote the sustainable development of China's online game industry and ensure the healthy and orderly progress of economic and social, this paper provides a reference for the legislation and judicial practice related to the crime of network virtual property.
