【摘要】：國內(nèi)外學(xué)術(shù)界對(duì)于群體性事件發(fā)生的社會(huì)心理機(jī)制討論較多,但卻相對(duì)忽視了個(gè)體參與者認(rèn)知心理因素更為基礎(chǔ)性的驅(qū)導(dǎo)功用與評(píng)估調(diào)控。從角色定位與演化過程相結(jié)合的雙重視角準(zhǔn)確認(rèn)識(shí)和把握群體性事件,在此基礎(chǔ)上借助認(rèn)知心理學(xué)的智識(shí)工具,精細(xì)化探究群體性事件發(fā)生的認(rèn)知心理機(jī)制,可以發(fā)現(xiàn)包括相對(duì)剝離感、歸因偏差、認(rèn)知偏見等認(rèn)知影響因子的交互作用,共同催化群體性事件的形成。群體性事件生成的認(rèn)知心理機(jī)制揭示,有助于從源頭上進(jìn)行群體性事件的化解應(yīng)對(duì)。對(duì)此其法治化防控治理既是可行必要的,又是最為可欲的。群體性事件防控治理對(duì)策在立法方面供學(xué)術(shù)討論的空間其實(shí)很有限,在執(zhí)法維度上要全面推進(jìn)依法行政,注重心理危機(jī)干預(yù)與疏導(dǎo),同時(shí)設(shè)置事件的多方救濟(jì)渠道,構(gòu)建政府、社會(huì)與市場(chǎng)協(xié)商共治框架;在司法維度上要注意鑄就司法權(quán)威,采取事件處理的多元化糾紛解決機(jī)制,同時(shí)推廣第三方訴訟服務(wù)模式,構(gòu)建與法院訴訟的良好銜接。
[Abstract]:There is much discussion about the social psychological mechanism of group events in the academic circles at home and abroad, but the more basic driving function and evaluation regulation of cognitive psychological factors of individual participants are neglected. From the dual perspective of the combination of role orientation and evolution process, we can accurately understand and grasp the group events, and on this basis, with the help of the intellectual tools of cognitive psychology, we can finely explore the cognitive psychological mechanism of the occurrence of group events. It can be found that the interaction of cognitive factors, such as relative detachment, attribution bias and cognitive bias, catalyzes the formation of group events. The cognitive psychological mechanism of the formation of group events is helpful to resolve the group events from the source. Therefore, it is necessary and most desirable to control the prevention and control by law. In fact, the space for academic discussion on the countermeasures of prevention and control of mass incidents is very limited. In the dimension of law enforcement, we should comprehensively promote administration according to law, pay attention to psychological crisis intervention and guidance, and set up various relief channels for incidents, so as to build a government. In the judicial dimension, we should pay attention to the judicial authority, adopt the diversified dispute resolution mechanism to deal with events, promote the service mode of third party litigation, and construct a good connection with the court litigation.
