【摘要】：我國(guó)現(xiàn)階段處于社會(huì)轉(zhuǎn)型期,有著不同于一般社會(huì)的特殊情況,群體性事件便是這一特定時(shí)期的產(chǎn)物。群體性事件嚴(yán)重影響公共秩序和社會(huì)穩(wěn)定,公安機(jī)關(guān)作為維護(hù)社會(huì)穩(wěn)定的重要力量,在發(fā)生群體性事件時(shí)必須通過(guò)對(duì)事件發(fā)生原因的分析,對(duì)處置原則的理解和對(duì)處置對(duì)策和措施的運(yùn)用,妥善處置群體性事件。因此正確處理群體性事件,并發(fā)揮公安機(jī)關(guān)在其中的重要作用非常關(guān)鍵。 當(dāng)前,公安機(jī)關(guān)在處理群體性事件時(shí)有許多問(wèn)題有待解決,公安機(jī)關(guān)在處置群體性事件時(shí)還面臨諸多執(zhí)法難點(diǎn)。因此,有必要制定處置群體性事件的法律規(guī)范,把處置群體性事件的工作納入法制化的軌道,以實(shí)現(xiàn)法律效果和社會(huì)效果的統(tǒng)一 論文分為四章： 第一章,群體性事件概述,著重論述群體性事件的內(nèi)涵和外延,得出筆者界定的群體性事件的含義和特征,并從群體性事件的發(fā)生頻度、組織、對(duì)抗性強(qiáng)度和社會(huì)輿論四個(gè)方面,分析了群體性事件的規(guī)律和發(fā)展趨勢(shì)。 第二章,從社會(huì)制度、傳統(tǒng)法律文化、公民權(quán)利意識(shí)等方面揭示群體性事件產(chǎn)生的原因,其原因是多元化的和復(fù)雜的。 第三章,筆者通過(guò)對(duì)群體性事件的分析,對(duì)公安機(jī)關(guān)在處理群體性事件中經(jīng)驗(yàn)教訓(xùn)給予了總結(jié),發(fā)現(xiàn)公安機(jī)關(guān)在處理群體性事件中存在的問(wèn)題,并對(duì)這些問(wèn)題進(jìn)行分析,主要問(wèn)題包括：相關(guān)法律的缺乏、預(yù)警機(jī)制不健全、處置不力和信息公開(kāi)不暢通等。 第四章,針對(duì)前面的問(wèn)題和教訓(xùn),筆者提出了公安機(jī)關(guān)解決群體性事件的法律對(duì)策。希望通過(guò)完善相關(guān)法律法規(guī)、建立信息反映渠道、完善預(yù)警信息系統(tǒng)、提供公安機(jī)關(guān)處置能力等措施應(yīng)對(duì)群體性事件,以使公安機(jī)關(guān)在以后的工作中能更好的發(fā)揮其為人民服務(wù)的職能。
[Abstract]:At present, China is in the period of social transformation, which is different from the special situation of the general society. Group events are the product of this particular period. Group events seriously affect public order and social stability. As an important force to maintain social stability, public security organs must pass the causes of events in the occurrence of mass events. Analysis, the understanding of the principles of disposal, the use of countermeasures and measures, and the proper disposal of mass events. Therefore, it is crucial to correctly handle group events and to play an important role in the public security organs.
At present, there are many problems in dealing with mass incidents by public security organs, and public security organs are faced with many difficulties in law enforcement when dealing with mass incidents. Therefore, it is necessary to formulate legal norms for dealing with group events and bring the work of dealing with group events into the track of legal system in order to achieve legal and social effects. The thesis is divided into four chapters.
The first chapter, the overview of group events, focuses on the connotation and extension of group events, and draws the meaning and characteristics of the group events defined by the author, and analyzes the law and development trend of group events from four aspects of the frequency, organization, antagonism and public opinion of the group events.
The second chapter reveals the causes of mass incidents from the aspects of social system, traditional legal culture and civil rights consciousness. The reasons are diverse and complex.
In the third chapter, through the analysis of group events, the author gives a summary of the experience and lessons of the public security organs in dealing with group events, and finds out the problems existing in the handling of mass incidents by public security organs and analyzes these problems. The main problems include the lack of relevant laws, the unsound early warning mechanism, poor disposal and information. The public is not open and so on.
In the fourth chapter, in view of the previous problems and lessons, the author puts forward the legal countermeasures for the public security organs to solve the group events. We hope that by improving the relevant laws and regulations, establishing information channels, improving the early warning information system and providing the capacity of the public security organs to deal with group events, the public security organs will be able to do more in the future work. Make good use of its functions for the people.
