【摘要】：21世紀(jì)以來,我國未成年人違法犯罪的現(xiàn)象日趨增加,社會(huì)各界越來越多的人士將目光投向了未成年犯的教育和改造問題。我國在立法和實(shí)際工作中對未成年犯多呈保護(hù)立場,而不是簡單地適用監(jiān)禁刑。在國外,作為教育矯正功能突出的社區(qū)矯正,已得到了普遍的適用。近年來,我國在吸收國外的一些經(jīng)驗(yàn)、教訓(xùn)的基礎(chǔ)上,開展了社區(qū)矯正工作,也取得了一定的成效,如北京、上海等地都形成了很好的社區(qū)矯正模式。但從我國對未成年犯社區(qū)矯正制度的探索情況來看,并未與成年犯區(qū)分開來,具體說來,主要包括如下問題：矯正過程流程化、矯正項(xiàng)目傳統(tǒng)化、矯正關(guān)系等級化、矯正隊(duì)伍非專業(yè)化等。在國外,最新流行的以證據(jù)為基礎(chǔ)的循證矯正被認(rèn)為是科學(xué)、有效的矯正模式。其核心是矯正工作者、研究者等結(jié)合矯正共性經(jīng)驗(yàn),根據(jù)矯正工作的實(shí)際情形,針對社區(qū)矯正對象的個(gè)性特征,檢索出相關(guān)的最佳證據(jù),設(shè)計(jì)、制定最佳矯正方案,選擇合適的矯正項(xiàng)目,科學(xué)實(shí)施矯正。與傳統(tǒng)的矯正模式相比,循證矯正具有民主性、科學(xué)性、專業(yè)性、有效性、整合性等特點(diǎn)。針對未成年犯自身的特點(diǎn)以及如前所述存在的一些現(xiàn)實(shí)問題,在我國未成年犯社區(qū)矯正中實(shí)施循證矯正不失為解決已有未成年犯社區(qū)矯正問題的途徑之一。無論是從理論基礎(chǔ)還是現(xiàn)實(shí)基礎(chǔ)上進(jìn)行分析,循證矯正都有運(yùn)用于我國未成年犯社區(qū)矯正的可能。根據(jù)我國現(xiàn)實(shí)情況,將循證矯正運(yùn)用于未成年犯社區(qū)矯正應(yīng)從重視矯正目標(biāo)、建立矯正數(shù)據(jù)庫、貫徹服務(wù)理念、健全管理機(jī)制等方面努力。
[Abstract]:Since the 21st century, the phenomenon of juvenile delinquency in our country has been increasing day by day, and more people from all walks of life have turned their attention to the education and reform of juvenile delinquents. In the legislative and practical work, our country takes a protective stand against juvenile delinquents, rather than simply applying the sentence of imprisonment. In foreign countries, as a prominent function of education correction, community correction has been widely applied. In recent years, on the basis of absorbing some experiences and lessons from foreign countries, our country has carried out community correction work and achieved certain results, such as Beijing, Shanghai and other places have formed a very good community correction model. However, from the exploration of community correction system for juvenile delinquents in China, it is not distinguished from adult offenders. Specifically, it mainly includes the following problems: the process of correction, the traditional items of correction, the hierarchy of correction relations, and so on. Correction team is not specialized, etc. Abroad, the latest popular evidence-based correction is regarded as a scientific and effective correction model. The core of it is that the correction workers and researchers combine the common experience of correction, according to the actual situation of correction, according to the individual characteristics of the community correction object, retrieve the relevant best evidence, design and formulate the best correction plan. Choose the right correction items, and carry out the correction scientifically. Compared with the traditional correction mode, Evidence-based correction is democratic, scientific, professional, effective and integrated. In view of the characteristics of juvenile delinquents and some practical problems as mentioned earlier, it is one of the ways to solve the problem of community correction of juvenile delinquents to implement evidence-based correction in the community correction of juvenile delinquents in our country. Evidence-based correction can be applied to the community correction of juvenile delinquents in China, both on the basis of theory and reality. According to the reality of our country, the application of evidence-based correction in community correction of juvenile delinquents should focus on the goal of correction, establish the database of correction, carry out the concept of service, and improve the management mechanism.
