【摘要】： 社會的發(fā)展,必然伴隨著利益的重新分配與調(diào)整,在此過程中又不可避免地會產(chǎn)生矛盾,而在矛盾雙方的對立與沖突不斷加劇的情況下,就很容易引發(fā)群體性事件,影響社會的穩(wěn)定。近年來群體性事件逐步呈頻發(fā)態(tài)勢,且往往具有規(guī)模較大、對抗性和破壞性較強等特點,因此無論從控制矛盾的進一步激化還是從維護社會正常秩序的需要出發(fā),都有必要運用警力來防范和遏制群體性事件的滋生與蔓延。在運用警力處置群體性事件的過程中,如何從現(xiàn)行法律法規(guī)上認識和界定群體性事件的違法行為,如何依法對群體性事件作出正確的處置而又不惡化群眾與政府的關(guān)系,如何在打擊違法犯罪行為的同時,積極引導群眾按照法律規(guī)定的正當渠道維護權(quán)益,都是需要認真研究和探索的課題。 本文試圖從群體性事件發(fā)生的成因、特點、演化過程的規(guī)律,來分析群體性事件罪與非罪的界限;從群體性事件的非法因素與危害事實,來考慮警力在處置群體性事件中的合法性問題;從群體性事件無序性、偶然性、和平性向暴力化、組織化、有預謀化等轉(zhuǎn)變的趨勢中,來論述警力在處置該類事件中的獨特作用及司法實踐中的地位;從慎用警力與合理運用警力解決沖突中找到平衡點,來設計出更策略更完善的預防與偵控手段,為公安部門在有針對性地預防及處置群體性事件時找出與地方政府行政干預的契合點,共同化解社會矛盾。
[Abstract]:The development of society is bound to be accompanied by the redistribution and adjustment of interests, and contradictions will inevitably arise in the process, and when the contradiction and conflict between the two sides are intensifying, it is easy to cause mass events. Affect the stability of society. In recent years, group events have been occurring frequently, and often have the characteristics of large scale, antagonistic and destructive, etc. Therefore, whether from the further intensification of control contradictions or from the need to maintain normal social order, It is necessary to use police force to prevent and control the breeding and spreading of mass incidents. In the process of using police force to deal with group incidents, how to recognize and define the illegal acts of group incidents from the current laws and regulations, how to deal with group incidents correctly according to law without deteriorating the relationship between the masses and the government, How to actively guide the masses to safeguard their rights and interests according to the legitimate channels stipulated by law while cracking down on illegal and criminal acts is a subject that needs to be studied and explored. This paper attempts to analyze the boundary between crime and non-crime of group events from the causes, characteristics and rules of evolution of group events, and from the illegal factors and harmful facts of group events, To consider the legality of the police force in dealing with group incidents; from the disorderly, accidental and peaceful nature of mass incidents to violent, organized, premeditated, and so on. To discuss the unique role of police force in dealing with this kind of incident and the position in judicial practice, to find the balance point between using police force prudently and using police force reasonably to solve conflict, to design more tactics and more perfect means of prevention and detection and control. In order to resolve the social contradiction, the public security department should find out the joint point with the local government administrative intervention when preventing and dealing with the group incident.
