【摘要】： 在我國,隨著高等教育從精英化向大眾化的逐漸普及和高等教育的跨越式發(fā)展,特別是高校辦學(xué)規(guī)模不斷擴(kuò)大,教育資金投入越來越多,高校參與經(jīng)濟(jì)活動越來越頻繁,高校與社會交往越加密切和復(fù)雜,基建規(guī)模和物資采購數(shù)量越來越大,致使各級管理人員的職務(wù)犯罪行為呈現(xiàn)擴(kuò)大化趨勢。失衡、錯(cuò)位的高等學(xué)校自主權(quán),引發(fā)高校管理的職務(wù)行為缺失規(guī)范和監(jiān)督,違背了高等學(xué)校管理的真實(shí)意義和制約了我國高等教育的健康發(fā)展。 本論文的創(chuàng)新之處在于在法律分析的基礎(chǔ)上,找出高校內(nèi)部管理等方面的不足,力圖構(gòu)建高校職務(wù)犯罪預(yù)防體系,提出當(dāng)前職務(wù)犯罪預(yù)防的對策和新思路。 綜合運(yùn)用文獻(xiàn)研究法和比較研究法等方法,依據(jù)高校職務(wù)犯罪基本內(nèi)涵的廓清,進(jìn)一步深刻剖析高校職務(wù)犯罪產(chǎn)生的客觀因素和行為主體的主觀原因。通過對中外職務(wù)犯罪預(yù)防理論的解讀,重新審視高校職務(wù)犯罪預(yù)防的理論、機(jī)制、運(yùn)行模式;同時(shí),從高等學(xué)校自主權(quán)和高校管理者職務(wù)兩個(gè)角度入手,創(chuàng)新高校職務(wù)犯罪預(yù)防體系,實(shí)現(xiàn)管理者樹立法制化治校理念,提升高等學(xué)校立法地位,建立教育、制度、監(jiān)督三者并重的預(yù)防體系和預(yù)警機(jī)制。
[Abstract]:In our country, with the gradual popularization of higher education from elite to popularization and the leap-forward development of higher education, especially the scale of running a university has been expanding, more and more educational funds have been invested, and the participation of colleges and universities in economic activities has become more and more frequent. The relationship between universities and society is more and more close and complicated, the scale of capital construction and the quantity of material purchase are more and more large, which results in the increasing trend of the duty crime behavior of managers at all levels. The imbalance and dislocation of the autonomy of colleges and universities lead to the lack of regulation and supervision of the duties of university management, which violates the true significance of the management of colleges and universities and restricts the healthy development of higher education in China. The innovation of this paper lies in finding out the deficiencies of internal management in colleges and universities on the basis of legal analysis, trying to construct the prevention system of duty crime in colleges and universities, and putting forward the countermeasures and new ideas for the prevention of duty crimes at present. By using the methods of literature research and comparative research, this paper analyzes the objective factors and subjective reasons of the subject of duty crime in colleges and universities according to the clarification of the basic connotation of duty crime in colleges and universities. Through the interpretation of the theory of duty crime prevention at home and abroad, this paper reexamines the theory, mechanism and operation mode of duty crime prevention in colleges and universities, and at the same time, from the perspectives of autonomy of institutions of higher learning and positions of administrators in colleges and universities, Innovating the duty crime prevention system of colleges and universities, realizing the administrators to set up the idea of rule by law, to promote the legislative status of colleges and universities, to establish the prevention system and early warning mechanism of education, system and supervision.
