【摘要】：遷徙自由是公民人身自由的重要組成部分，，也是重要的基本人權(quán)之一。新中國(guó)自1949年建立后，采取了優(yōu)先發(fā)展工業(yè),優(yōu)先發(fā)展城市，特別是大中城市的發(fā)展戰(zhàn)略。1958年通過(guò)的《中華人民共和國(guó)戶口登記條例》建立了我國(guó)特有的城鄉(xiāng)二元戶籍管理制度，實(shí)質(zhì)上剝奪了公民的遷徙權(quán)，也違反了憲法的平等原則。2014年國(guó)務(wù)院出臺(tái)的《關(guān)于進(jìn)一步推進(jìn)戶籍制度改革的意見(jiàn)》明確提出建立城鄉(xiāng)統(tǒng)一的戶口登記制度、建立居住證制度、逐步落實(shí)放寬戶口遷移政策等戶籍制度改革的方向，開(kāi)啟了我國(guó)戶籍管理制度改革的新紀(jì)元，但該意見(jiàn)仍然存在法律位階低，效力不高及具體內(nèi)容與平等權(quán)及遷徙自由的要求相矛盾等不足。為推動(dòng)我國(guó)的戶籍管理制度改革，應(yīng)遷徙自由入憲，通過(guò)憲法明確公民的遷徙權(quán)，加快戶籍管理制度立法進(jìn)程，制定《中華人民共和國(guó)戶籍法》以及配套制度的完善。
[Abstract]:Freedom of movement is an important part of the personal freedom of citizens and one of the important basic human rights. Since the founding of New China in 1949, priority has been given to the development of industry and cities. In particular, the development strategy of large and medium-sized cities. The regulations of the people's Republic of China on hukou Registration, adopted in 1958, established a unique urban and rural dual household registration management system in China, which in essence deprived citizens of their right to migrate. It also violates the principle of equality in the Constitution. In 2014, the State Council issued the "opinions on further promoting the Reform of the Household Registration system", which explicitly proposed the establishment of a unified household registration system for urban and rural areas and the establishment of a residence permit system. Gradually implementing the direction of the reform of the household registration system, such as relaxing the policy of household registration migration, has opened a new era for the reform of the household registration management system in China, but this opinion still has a low legal rank. The effectiveness is not high and the concrete content contradicts with the requirement of equality right and freedom of movement and so on. In order to promote the reform of the household registration management system in our country, we should move freely into the constitution, make clear the citizens' right to migrate through the constitution, speed up the legislative process of the household registration management system, and formulate the "Household Registration Law of the people's Republic of China" and the perfection of the supporting system.
