【摘要】：1997年刑法適應(yīng)我國有組織犯罪的發(fā)展現(xiàn)狀,明確規(guī)定了黑社會性質(zhì)組織犯罪,但在刑法理論上和司法實(shí)務(wù)中仍有諸多問題需要研究解決。本文通過對黑龍江省黑社會性質(zhì)組織犯罪案件41件533人入手,對黑社會性質(zhì)組織犯罪案件進(jìn)行較為細(xì)致、深入地調(diào)查研究。全文共分三章。第一章介紹黑龍江省黑社會性質(zhì)組織犯罪案件的基本情況。第二章重點(diǎn)闡述了各訴訟環(huán)節(jié)在查處黑社會性質(zhì)組織犯罪案件分歧問題。第三章提出對黑社會性質(zhì)組織犯罪立法及司法建議。
[Abstract]:The criminal law of 1997 adapts to the present situation of organized crime in our country, and clearly stipulates the organized crime of underworld character. However, there are still many problems in the theory of criminal law and judicial practice that need to be studied and solved. This article starts with 41 criminal cases of organized crime of underworld nature in Heilongjiang Province, and makes a detailed investigation and research on the criminal cases of organized crime of underworld nature. The full text is divided into three chapters. The first chapter introduces the basic situation of criminal cases of underworld organization in Heilongjiang Province. The second chapter focuses on the different issues in investigating and dealing with the criminal cases of organized crime of underworld nature. The third chapter puts forward the legislative and judicial suggestions on the crime of underworld organizations.
