【摘要】： 近幾年,雖然學(xué)術(shù)界和實務(wù)部門對職務(wù)犯罪偵查情報建設(shè)方面的研究越來越多,但是大多集中于如何建立一個完善的情報系統(tǒng),對職務(wù)犯罪偵查情報全面研究的較少。而職務(wù)犯罪偵查情報建設(shè)是一個系統(tǒng)的工程,要建立完善的職務(wù)犯罪偵查情報體系離不開對職務(wù)犯罪偵查情報的全面研究。本文正是基于這一想法,在收集了大量的關(guān)于職務(wù)犯罪偵查中情報的收集,應(yīng)用等方面的資料和案例的基礎(chǔ)上,又結(jié)合了在重慶市沙坪壩區(qū)檢察院職務(wù)犯罪偵查局的實習(xí)經(jīng)歷和自有的專業(yè)知識進行寫作,力求本文的內(nèi)容對職務(wù)犯罪偵查的情報建設(shè)能起到一定的作用。 本文運用了舉例、對比、歸納、文獻研究等等論證方法,既有理論的研究也有實踐的考察,在成文過程中通過對中西方情報建設(shè)的研究,通過理論與實踐的結(jié)合、力求全面闡述職務(wù)犯罪偵查的情報建設(shè)問題。而至于參考資料,多數(shù)來自于圖書館的書籍、期刊和報紙以及網(wǎng)絡(luò)數(shù)據(jù)庫等。同時,通過幾年的深入學(xué)習(xí),筆者也斗膽加入了更多自己的理論,以表達自己微弱且不成熟的聲音。 本文總體上分為四個部分。第一部分是對職務(wù)犯罪偵查情報的概述,先通過對情報概念的對比分析上升到對職務(wù)犯罪偵查情報的理解,明確何為職務(wù)犯罪偵查情報,職務(wù)犯罪偵查情報是指對依法運用公開和秘密的方法獲得的有關(guān)職務(wù)犯罪活動的人、事、物以及時間、空間等方面情況的信息經(jīng)過篩選、加工、分析、研判后形成的系統(tǒng)化的對研究職務(wù)犯罪有意義的信息。從不同的角度,對職務(wù)犯罪偵查情報進行分類,為其后邊的分析、研判和應(yīng)用打下基礎(chǔ),這部分是全文的基礎(chǔ)部分. 第二部分是對職位犯罪偵查情報收集的論述,從概念到原則、方法均有闡述;收集過程中要注意嚴格遵守依法收集、有針對性收集以及公開與秘密相結(jié)合收集的原則,主動與被動收集手段相結(jié)合,已達到事倍功半的效果. 第三部分論述了職位犯罪偵查情報的分析、研判和應(yīng)用,以理論和實踐相結(jié)合闡明其特點、原則、方法等,筆者提出了國外的一些分析、研判方法,基于不同的目的,對職務(wù)犯罪偵查情報的分析、研判方法也不盡相同,之后提出了將其應(yīng)用于在初查階段、立案階段以及預(yù)防階段的方法,其中包含了實踐中總結(jié)了部分方法以供參考. 第四部分是在指出職務(wù)犯罪偵查情報建設(shè)不足之處的同時,又有針對性的提出完善職務(wù)犯罪偵查情報工作的建議,較多包含了筆者的觀點,包括對情報收集方法的建議、在分析、研判和應(yīng)用階段加強技術(shù)支持,建議各種情報系統(tǒng)聯(lián)網(wǎng)等等,最后對建設(shè)職務(wù)犯罪偵查情報系統(tǒng)提出了自己的觀點,這部分對也是本文的重點部分。
[Abstract]:In recent years, although the academic and practical departments have more and more research on the investigation of information construction in the investigation of duty crime, most of them are concentrated on how to establish a perfect information system and less comprehensive research on the investigation and information of duty crime. The construction of the investigation and information of the duty crime is a systematic project, and a perfect job crime should be established. The investigation and information system can not be separated from the comprehensive study of the investigative intelligence of the duty crime. This article is based on this idea. On the basis of collecting a large number of information and cases on the collection, application and other aspects of the investigation of duty crime, it also combines the practice and self experience of the duty crime investigation bureau of the Shapingba District Procuratorate in Chongqing. Some professional knowledge is written, and the content of this article can play a certain role in intelligence construction of job-related crimes investigation.
This article uses examples, contrast, induction, literature research and other demonstration methods, both theoretical research and practical investigation. In the process of writing, through the study of the Chinese and western information construction, through the combination of theory and practice, we strive to comprehensively elaborate the construction of the investigation of the crime of duty crime. As for the reference materials, most of them come from the drawings. Books, periodicals, newspapers, and network databases, etc., and through years of intensive study, the author also joins in more theories to express his weak and immature voice.
This article is divided into four parts as a whole. The first part is an overview of the investigation information of the duty crime, first through the comparison and analysis of the concept of information to the understanding of the investigation information of the duty crime, and clearly what the investigation information is for the duty crime, and the investigation information of the duty crime refers to the relevant duties obtained by using the public and secret methods according to law. The information of people, things, things and time, space and other aspects of criminal activities through screening, processing, analyzing, and studying the systematic and meaningful information on the study of job crime. From different angles, it classifies the investigation information of duty crime, and lays the foundation for the analysis, analysis and application of the crime. This part is the basis of the full text. The foundation.
The second part is the exposition of information collection on the investigation of job crime, from concepts to principles and methods. In the collection process, we should pay attention to the principle of strict compliance with the law collection, targeted collection and the combination of public and secret collection, and the combination of active and passive collection methods, which has achieved the result of half the effort.
The third part discusses the analysis, judgment and application of the investigation information of the position crime, and expounds its characteristics, principles and methods by combining theory with practice. The author puts forward some analysis and research methods abroad, and based on different purposes, the analysis of the investigation information of the crime of duty is not the same, and then it is put forward to apply it to it. In the initial stage of investigation, the methods of filing and preventive stage include some methods summarized in practice for reference.
The fourth part is to point out the shortcomings of the investigation and information construction of the investigation of the duty crime, and also put forward some suggestions to improve the investigation and information work of the duty crime, including the author's views, including the suggestion of the information collection method, the strengthening of the technical support in the analysis, the study and the application stage, and the suggestion of the interconnection of various information systems, etc. Finally, we put forward our own views on the construction of crime detection intelligence system, which is also the key part of this article.
