【摘要】：近年來，隨著“平安中國”和“天網(wǎng)工程”等大型安防工程的建設(shè)，我國各大中城市乃至鄉(xiāng)鎮(zhèn)的公共場所、企事業(yè)單位甚至個人基于各種目的所安裝的電子監(jiān)控設(shè)備覆蓋面越來越大，密度越來越高。這使得許多案件的經(jīng)過情況可能被監(jiān)控設(shè)備及時、客觀的捕獲，成為偵查機關(guān)發(fā)現(xiàn)即時作案、鎖定犯罪嫌疑人、重建現(xiàn)場、判斷案情、開展串并案件的重要依據(jù)和途徑。但是，偵查實踐中越來越多的犯罪嫌疑人否認視頻監(jiān)控中所記錄的人像是其本人，，導(dǎo)致視頻資料的證明力處于不確定狀態(tài)或者有所下降。為了拓展視頻圖像的“證據(jù)化應(yīng)用”，對視頻圖像內(nèi)容信息進行深度研判分析開展具體視頻圖像中人像和物像的同一認定逐漸成為聲像資料司法鑒定領(lǐng)域的熱點問題。 本文試圖對視頻圖像同一認定進行框架性研究。從視頻圖像同一認定的理論研究出發(fā)，深入探討對其進行同一認定的獨特性。運用前述理論指導(dǎo)實踐，結(jié)合實踐中相關(guān)實戰(zhàn)案例探討開展同一認定的具體方法。論述認定主體如何運用同一性思維對視頻圖像進行綜合深入評斷，從而發(fā)現(xiàn)具體實踐中面臨的困境。以期對促進視頻圖像在犯罪偵查和司法鑒定中的應(yīng)用，在理論和實踐層面上的推進有所裨益。 本文分為四個部分； 第一部分是對視頻圖像同一認定的概述。分別介紹了視頻圖像同一認定所涉的概念，具體包含的對象范圍。分析了與傳統(tǒng)的物證同一認定相比，視頻圖像同一認定本身具有的特點。同時，對視頻圖像偵查的同一鑒別與司法鑒定的同一認定進行區(qū)分和探討。 第二部分是從理論層面對開展視頻圖像同一認定的科學(xué)基礎(chǔ)進行論證。闡述其依據(jù)和具體實施條件，目的在于回答兩個基本問題：為什么視頻圖像同一認定具有科學(xué)性？怎樣對視頻圖像進行同一認定才能體現(xiàn)其科學(xué)性。 第三部分對實務(wù)中開展視頻圖像同一認定的依據(jù)和使用的具體方法進行闡述，從鑒定對象特征的識別方法到特征比對檢驗，綜合評斷等方面結(jié)合具體案例進行分析。 第四部分是對現(xiàn)階段視頻圖像同一認定面臨的主要困境進行闡述。從圖像的模糊問題、專業(yè)人才隊伍培養(yǎng)、專門化鑒定軟件技術(shù)研發(fā)、完善相關(guān)法律規(guī)范等方面對視頻圖像同一認定面臨的具體問題進行深層剖析。
[Abstract]:In recent years, with the construction of large-scale security projects such as "Ping'an China" and "Skynet Project", public places in large and medium-sized cities and even towns in China, The coverage and density of electronic monitoring equipment installed by enterprises and even individuals for various purposes are becoming larger and higher. This makes the situation of many cases may be timely and objective capture by monitoring equipment, and become an important basis and approach for investigation organs to find immediate crimes, lock down criminal suspects, rebuild the scene, judge the circumstances of the case, and carry out serial cases. However, more and more criminal suspects deny that the image recorded in the video surveillance is themselves, which leads to the uncertainty or decline of the proof power of the video data. In order to expand the "evidential application" of video image, it has become a hot issue in the field of forensic identification of audio and video data to analyze the content information of video image and identify the identity of human image and object image in specific video image. This paper attempts to frame the identification of video image identity. Based on the theoretical study of identity recognition of video images, the uniqueness of identity recognition of video images is discussed in depth. Using the theory to guide the practice, combined with the practice of practical cases to explore the specific methods to develop the same identification. This paper discusses how to use identity thinking to comprehensively judge video images and find out the dilemma in practice. In order to promote the application of video images in crime investigation and judicial identification, in the theoretical and practical level of the promotion of some benefits. This paper is divided into four parts; The first part is an overview of the same recognition of video images. This paper introduces the concept of video image identity, including the scope of the object. Compared with the traditional identification of physical evidence, video image identity recognition has its own characteristics. At the same time, the same identification of video image detection and the same identification of judicial identification are distinguished and discussed. The second part is to demonstrate the scientific basis of the identity of video image from the theoretical level. Explain its basis and specific implementation conditions, the purpose is to answer two basic questions: why video image identity is scientific? How to identify the same video image in order to reflect its scientific nature. In the third part, the author expounds the basis and the specific methods used to identify the identity of video images in practice, from the identification method of the identification object to the feature comparison test, comprehensive evaluation and other aspects of the analysis of specific cases. The fourth part is to explain the main dilemma that video image identity is facing at this stage. From the aspects of image blur, professional personnel training, specialized identification software technology research and development, improve the relevant legal norms and other aspects of the video image identity to identify the specific problems faced by in-depth analysis.
