【摘要】：我國已經(jīng)進(jìn)入深化改革的階段，經(jīng)濟(jì)社會處于轉(zhuǎn)型關(guān)鍵時期。人們的世界觀、價(jià)值觀都在發(fā)生變化。未成年人因?yàn)榧彝ソ逃娜笔�、學(xué)校的管教不力，加上不良思想風(fēng)氣的誘導(dǎo)，容易誘發(fā)犯罪。加大對未成年人的犯罪行為的預(yù)防，對于未成年犯罪予以進(jìn)行矯正，是當(dāng)前社會治安的重中之重。 傳統(tǒng)的刑罰觀念以報(bào)應(yīng)刑為主，對犯罪分子強(qiáng)調(diào)以嚴(yán)懲作為威懾，隨著社會的發(fā)展，人們發(fā)現(xiàn)用嚴(yán)懲手段對待那些身體發(fā)育尚不健全、心理尚不穩(wěn)定的未成年人，使用嚴(yán)懲刑罰更值得商榷。我國的刑罰理念順應(yīng)世界先進(jìn)國家的主流刑罰理念，用恢復(fù)性司法、刑罰謙抑、深化復(fù)歸思想取代傳統(tǒng)的報(bào)應(yīng)理念。正是這種理念的改變，對社區(qū)矯正制度的改革起到了促進(jìn)作用，社區(qū)矯正機(jī)構(gòu)可以充分利用社區(qū)的資源對未成年犯進(jìn)行針對性的監(jiān)督與改造，從教育、就業(yè)、技能、心理、救助等幾個方面為未成年犯提供幫助，實(shí)現(xiàn)改造、教育、升華的效果。 我國業(yè)于2003年由最高人民法院、最高人民檢察院、公安部、司法部聯(lián)合下發(fā)了《關(guān)于開展社區(qū)矯正試點(diǎn)工作的通知》，各地紛紛進(jìn)行試點(diǎn)工作。但是，當(dāng)前我國的未成年犯社區(qū)矯正工作尚處于探索階段，很多做法與司法程序、實(shí)體法存在著沖突。 針對這樣的背景情況，本文在對國內(nèi)外文獻(xiàn)梳理歸納的基礎(chǔ)上，探討了未成年人犯罪的成因以及分析研究了未成年犯罪的社區(qū)矯正相關(guān)理論，為本文的研究找到相應(yīng)的理論依據(jù)。隨后，，以H區(qū)的未成年犯社區(qū)矯正現(xiàn)狀作為研究對象，采用了定量研究、定性研究進(jìn)行了實(shí)地調(diào)研，對工作現(xiàn)狀以及存在問題進(jìn)行分析研究，并借鑒國內(nèi)外先進(jìn)的未成年犯的社區(qū)矯正工作經(jīng)驗(yàn)，結(jié)合本地實(shí)際情況，提出了一系列優(yōu)化未成年犯社區(qū)矯正工作機(jī)制的對策，希望通過研究，能夠?yàn)榻窈笪闯赡攴干鐓^(qū)矯正工作的實(shí)際操作提供一些借鑒和參考。
[Abstract]:Our country has entered the stage of deepening reform, and the economy and society are in the critical period of transformation. People's world outlook and values are changing. Because of the lack of family education, the weak discipline of school and the inducement of unhealthy ideology, minors are apt to induce crime. To strengthen the prevention of juvenile delinquency and to correct juvenile crime is the most important part of social security. The traditional concept of punishment is based on retribution, emphasizing severe punishment as a deterrent to criminals. With the development of society, people find that severe punishment is used to treat minors whose physical development is not perfect and whose psychology is not stable. The use of severe punishment is more debatable. The penalty idea of our country conforms to the mainstream penalty idea of the advanced countries in the world, and replaces the traditional retribution idea with the restorative justice, the penalty modesty and the deepening of the thought of reversion. It is the change of this concept that has promoted the reform of the community correction system. Community correction institutions can make full use of the resources of the community to supervise and reform juvenile delinquents, from education, employment, skills, psychology, Aid and other aspects for juvenile offenders to provide help, to achieve transformation, education, sublimation effect. In 2003, the Supreme people's Court, the Supreme people's Procuratorate, the Ministry of Public Security and the Ministry of Justice jointly issued the notice on the pilot work of Community Correction, and all localities carried out the pilot work one after another. However, at present, the community correction of juvenile delinquents in our country is still in the exploratory stage, and many practices conflict with the judicial procedure and substantive law. In view of this background situation, this paper discusses the causes of juvenile delinquency and analyzes and studies the relevant theories of community correction of juvenile delinquency on the basis of combing and summarizing the domestic and foreign literature. To find the corresponding theoretical basis for the study of this paper. Then, taking the status quo of juvenile delinquents' community correction in H area as the research object, the paper adopts quantitative research, qualitative research, field investigation, analysis and research on the status quo of work and existing problems. And draw lessons from the domestic and foreign advanced juvenile delinquents' community correction work experience, combined with the actual situation of the local, put forward a series of measures to optimize the mechanism of juvenile delinquents' community correction work, hope through the research, It can provide some reference and reference for the practical operation of community correction of juvenile delinquents in the future.
