【摘要】：社區(qū)矯正是行刑社會化、人道化的必然表現(xiàn)形式,在刑罰謙抑性思想和"預(yù)防犯罪、減少犯罪、化解矛盾、促進和諧"的刑事法律制度和行刑理念的推動下,兩高兩部聯(lián)合下發(fā)了《關(guān)于開展社區(qū)矯正試點工作的通知》,各地據(jù)此開展了社區(qū)矯正的實踐。陜西省于2010年全面推行了社區(qū)矯正工作試點,在此期間,由于各項基本條件的限制,公檢法司配合協(xié)調(diào)不到位,群眾認同度不高,又缺乏法律依據(jù),使得此項工作的推進受到很大的制約。為此,需要完善相關(guān)立法,確定編制機構(gòu)和保障經(jīng)費,做好宣傳教育工作,提高人們的思想認識,做好公檢法司各方的配合、協(xié)調(diào),有效推進社區(qū)矯正工作,保證刑事法律制度和行刑理念的落實。
