【摘要】：社區(qū)矯正制度的設(shè)立是人類文明發(fā)展和人類刑罰制度進(jìn)步的產(chǎn)物。社區(qū)矯正因?yàn)槠浞闲塘P輕緩化的發(fā)展規(guī)律及方向,以及行刑社會(huì)化思想和人道主義理念,在許多國(guó)家中施行并快速發(fā)展。我國(guó)引入社區(qū)矯正制度的時(shí)間雖然才短短十多年,但已取得長(zhǎng)足發(fā)展。然而,發(fā)展過(guò)程中逐漸暴露出各式問(wèn)題和不足。我國(guó)已有的文獻(xiàn)資料,已經(jīng)追溯了社區(qū)矯正的起源、概念和理論基礎(chǔ),以及適用范圍、主體、社會(huì)參與并開(kāi)展實(shí)例研究,同時(shí)對(duì)社區(qū)矯正的域外實(shí)踐進(jìn)行比較分析等系列問(wèn)題進(jìn)行了深入的研究,但缺少對(duì)社區(qū)矯正群體的關(guān)注和研究。社區(qū)矯正制度的客體是社區(qū)矯正人員,而農(nóng)村社區(qū)矯正人員更應(yīng)成為關(guān)注和研究的重點(diǎn)。幫助社區(qū)矯正人員重新融入社會(huì)并成功實(shí)現(xiàn)再社會(huì)化,是社區(qū)矯正制度設(shè)立的初衷和追求。本文以惠安縣為研究目標(biāo),運(yùn)用社區(qū)調(diào)查法,收集了惠安縣社區(qū)矯正及農(nóng)村社區(qū)矯正人員再社會(huì)化的第一手資料,并進(jìn)行分析。調(diào)查結(jié)果顯示農(nóng)村社區(qū)矯正人員再社會(huì)化的困難源于社區(qū)矯正制度本身的不足、外部環(huán)境的影響、矯正人員自身原因等三方面。通過(guò)借鑒國(guó)內(nèi)外先進(jìn)經(jīng)驗(yàn),提出了改革與完善社區(qū)矯正工作機(jī)制、完善社區(qū)矯正人員再社會(huì)化外部環(huán)境、社區(qū)矯正人員發(fā)揮主觀能動(dòng)性主動(dòng)適應(yīng)社會(huì)等對(duì)策,幫助矯正人員能更好地實(shí)現(xiàn)再社會(huì)化。
[Abstract]:The establishment of community correction system is the result of the development of human civilization and the progress of human penalty system.Community correction has been carried out and developed rapidly in many countries because it accords with the development law and direction of penalty mitigation, as well as the socialization of execution and humanitarianism.Although the introduction of community correction system in China has only been more than ten years, it has made great progress.However, the process of development gradually exposed a variety of problems and deficiencies.The existing literature in China has traced the origin, concept and theoretical basis of community correction, as well as the scope of application, subject, social participation and case study.At the same time, a series of problems, such as comparative analysis of the extraterritorial practice of community correction, are deeply studied, but lack of attention and research to community correction groups.The object of the community correction system is the community correction personnel, and the rural community correction personnel should be the focus of attention and research.It is the original intention and pursuit of the establishment of community correction system to help the community correction personnel reintegrate into society and realize the social re-socialization successfully.Taking Huian County as the research goal, this paper collects the first-hand data of community correction and the re-socialization of rural community correction personnel in Huian County by using the method of community investigation, and makes an analysis.The results show that the difficulties of resocialization of community correction personnel in rural areas are due to the deficiency of community correction system itself, the influence of external environment, and the causes of correction personnel themselves.Based on the advanced experience at home and abroad, this paper puts forward some countermeasures, such as reforming and perfecting the working mechanism of community correction, perfecting the external environment of re-socialization of community correction personnel, and bringing the subjective initiative of community correction personnel into full play to adapt to the society, etc.Help correctional personnel to achieve better re-socialization.
