【摘要】： 社區(qū)矯正,顧名思義就是將符合一定條件的罪犯放在社區(qū)中進行管理、監(jiān)督和教育,使其更好的融入社會,達到再社會化的目的。社區(qū)矯正起源于西方,它是各國在不斷進行刑罰制度的創(chuàng)新,嘗試用人道、文明的方式來解決犯罪而產(chǎn)生的新的刑罰執(zhí)行方式,本質(zhì)上是一種教育刑。在美國,社區(qū)矯正已經(jīng)有160多年的歷史,而且已經(jīng)形成一套比較完整的社區(qū)矯正制度;但是在我國,社區(qū)矯正試點只是近幾年的事情,無論在矯正理念、社區(qū)硬件、立法層面還是執(zhí)法環(huán)節(jié)都存在缺陷,因此我國還沒有形成一套符合本土實際情況的社區(qū)矯正制度。這就需要我們?nèi)フ{(diào)查研究,從中找出問題和差距。 筆者對居住地附近的社區(qū)矯正對象、矯正社工和社區(qū)群眾三大類人員進行了問卷調(diào)查或訪談,獲得了第一手資料,在調(diào)查后對調(diào)查數(shù)據(jù)進行了整理和分析,總結(jié)出我國社區(qū)矯正試點中存在的突出問題。同時本文運用理論分析法就中美社區(qū)矯正的某些方面進行了比較。最后對我國社區(qū)矯正制度的構(gòu)建與完善提出了幾點建議。 本文分為四大部分: 第一部分:社區(qū)矯正的基本理論。在這一部分中,主要是對社區(qū)矯正的概念、矯正理論依據(jù)、矯正試點推行的必要性以及當前我國社區(qū)矯正試點基本狀況做了簡單的交代,為下文進行充分的調(diào)查分析做了必要準備。 第二部分:山東省社區(qū)矯正試點推行狀況調(diào)查。這一部分運用調(diào)查分析法,首先對在山東淄博和濟南調(diào)查的實際情況進行了必要的交代,并且對調(diào)查數(shù)據(jù)進行了統(tǒng)計,然后對矯正對象、矯正社工和社區(qū)群眾三大類人員進行分類研究,從中發(fā)現(xiàn)了我國在社區(qū)矯正試點中普遍存在的問題。 第三部分:中美社區(qū)矯正司法實踐比較。在這一部分中,通過運用理論分析法就中美在社區(qū)矯正形式、適用范圍和執(zhí)行機制等方面進行了比較。通過美國完善的社區(qū)矯正制度,我們找到了中美的差距,從而為我國社區(qū)矯正制度的構(gòu)建與完善提供可資借鑒的經(jīng)驗。 第四部分:我國社區(qū)矯正制度的構(gòu)建與完善。在這一部分中,筆者運用綜合分析法,從社區(qū)矯正的刑罰理念、矯正社區(qū)環(huán)境、立法狀況、執(zhí)行機制和未成年犯矯正教育等方面對我國社區(qū)矯正制度的構(gòu)建與完善提出了幾點建議。
[Abstract]:Community correction, as the name implies, is to put the criminals who meet certain conditions in the community for management, supervision and education, so as to better integrate them into society and achieve the purpose of re-socialization.Community correction originated from the west, it is the innovation of penalty system in various countries, trying to solve the crime with humanity and civilization, it is a kind of education punishment in essence.In the United States, community correction has a history of more than 160 years, and has formed a relatively complete system of community correction. But in our country, the pilot project of community correction is only a matter of recent years, whether in the concept of correction or in community hardware.There are defects in legislation and law enforcement, so there is not a set of community correction system in accordance with the local reality.This requires us to investigate and study to find out the problems and gaps.The author conducted a questionnaire survey or interview with the community correction objects, correction social workers and community masses, obtained first-hand information, collated and analyzed the survey data after the investigation.Summarize the outstanding problems existing in the community correction pilot project in our country.At the same time, this paper compares some aspects of community correction between China and America by theoretical analysis.Finally, some suggestions on the construction and perfection of community correction system in China are put forward.This paper is divided into four parts:The first part: the basic theory of community correction.In this part, the concept of community correction, the theoretical basis of correction, the necessity of carrying out correction pilot projects and the basic situation of community correction pilot projects in our country are briefly explained.Necessary preparations are made for the following investigation and analysis.The second part: Shandong Province community correction pilot implementation situation investigation.In this part, by means of investigation and analysis, the necessary account is given to the actual situation of the investigation in Zibo and Jinan, Shandong, and the survey data are counted, and then the objects of correction are analyzed.The classification of the three categories of correction social workers and community masses is studied, and the common problems in the community correction pilot projects are found in our country.The third part: the comparison of judicial practice of community correction between China and America.In this part, through the use of theoretical analysis, the form of community correction, the scope of application and the implementation mechanism between China and the United States are compared.Through the perfect community correction system in the United States, we have found the gap between China and the United States, thus providing reference experience for the construction and improvement of the community correction system in our country.The fourth part: the construction and perfection of community correction system in our country.In this part, the author uses the comprehensive analysis method, from the community correction penalty concept, corrects the community environment, the legislation condition,Some suggestions on the construction and perfection of community correction system in China are put forward in the aspects of execution mechanism and juvenile correction education.
