論國(guó)家機(jī)關(guān)工作人員職務(wù)犯罪的控制模式

【摘要】: 國(guó)家機(jī)關(guān)工作人員的職務(wù)犯罪對(duì)國(guó)家的政治建設(shè)、經(jīng)濟(jì)建設(shè)具有較強(qiáng)的破壞作用。研究和健全職務(wù)犯罪的控制模式對(duì)預(yù)防職務(wù)犯罪、完善法治建設(shè)、提高黨的執(zhí)政能力與公信力具有積極的促進(jìn)作用。 文章分為以下幾個(gè)部分: 第一部分的內(nèi)容為機(jī)關(guān)工作人員職務(wù)犯罪控制的概述。一是職務(wù)犯罪控制的理論基礎(chǔ)。首先,規(guī)范機(jī)關(guān)工作人員職務(wù)行為是國(guó)家發(fā)展的需要。其次,控制職務(wù)犯罪的本質(zhì)是限制公權(quán)、保障民權(quán)。二是我國(guó)機(jī)關(guān)工作人員職務(wù)犯罪的現(xiàn)狀。我國(guó)機(jī)關(guān)工作人員的職務(wù)犯罪已經(jīng)嚴(yán)重破壞了政府公信力和執(zhí)政形象,損害了國(guó)家和民眾的大量合法權(quán)益,影響了黨的政治建設(shè)和法治建設(shè)。三是機(jī)關(guān)工作人員職務(wù)犯罪的特點(diǎn)。文章通過兩則案例詳細(xì)說明該類犯罪的特點(diǎn),機(jī)關(guān)工作人員職務(wù)犯罪均是通過公權(quán)力對(duì)公共管理資源的集中控制,在外部與內(nèi)部監(jiān)督形同虛設(shè)的情況下,違背公務(wù)道德和職務(wù)行為正當(dāng)性,以個(gè)人微弱的力量扭曲了國(guó)家強(qiáng)大的管理意志,用低廉的成本給國(guó)家和個(gè)人造成了巨大損失。四是世界各國(guó)對(duì)職務(wù)犯罪的控制模式。一些國(guó)家在反腐敗和懲治職務(wù)犯罪的實(shí)踐中積累了各具特色的成功經(jīng)驗(yàn)。如道德教化、高薪養(yǎng)廉、法律嚴(yán)密、賦權(quán)懲治、政治透明、正本“浚源”等模式。注意多種措施的綜合運(yùn)用,正在成為當(dāng)今世界反貪浪潮中引人注目的一種有效對(duì)策而受到越來越多的國(guó)家的青睞,只有對(duì)職務(wù)犯罪進(jìn)行綜合治理,才能達(dá)到標(biāo)本兼治的目的。 第二部分的內(nèi)容為我國(guó)對(duì)職務(wù)犯罪控制的現(xiàn)狀。我國(guó)現(xiàn)有的職務(wù)犯罪控制模式中,道德教育和公眾監(jiān)督發(fā)揮的作用日益明顯,但是缺少道德法制化和信息公開化的前提。紀(jì)檢監(jiān)察和司法監(jiān)督是控制犯罪的根本保障,監(jiān)督權(quán)利的獨(dú)立行使與地方利益存在的矛盾仍需要進(jìn)一步解決。內(nèi)部監(jiān)督中厘清監(jiān)督者與被監(jiān)督者之間的關(guān)系并建立監(jiān)督者的權(quán)益保障機(jī)制是發(fā)揮內(nèi)部監(jiān)督優(yōu)勢(shì)的重要內(nèi)容。 第三部分的內(nèi)容為改善當(dāng)前職務(wù)犯罪控制模式。第一,解決瀆職犯罪輕刑化問題,增強(qiáng)對(duì)職務(wù)犯罪的震懾和懲治力度。第二,強(qiáng)化外部監(jiān)督組織和監(jiān)督權(quán)力的作用,依法對(duì)職務(wù)行為進(jìn)行控權(quán)監(jiān)督。第三,改善公共管理領(lǐng)域的內(nèi)部監(jiān)督,建立職務(wù)行為人的身份權(quán)益保障制度,注重職務(wù)行為的事中規(guī)范。第四,促進(jìn)信息公開化,建立職務(wù)行為監(jiān)督與職務(wù)犯罪偵查的信息體系,使職務(wù)犯罪控制模式具備靈敏的發(fā)現(xiàn)功能。第五,解決由少數(shù)機(jī)關(guān)工作人員決定大量社會(huì)公共管理資源分配的問題,改變資源分配方式。第六,加快機(jī)關(guān)工作人員道德法制化建設(shè),用法律強(qiáng)制方式在職務(wù)思維中植入公平正義、恪盡職守的道德理念。
[Abstract]:The official crime of state organ staff has a strong destructive effect on the political construction and economic construction of the country.
