【摘要】: 勞動教養(yǎng)制度是我國獨創(chuàng)的一項法律制度,自設(shè)立以來近半個世紀(jì),在維護國家安全和社會穩(wěn)定、預(yù)防和減少違法犯罪、教育挽救青少年等方面發(fā)揮了其獨特的作用。但隨著我國的政治、經(jīng)濟、文化等各方面的發(fā)展,特別是“依法治國,建設(shè)社會主義法治國家”方略的確立和對人權(quán)保障的日益重視,勞動教養(yǎng)制度自身的缺陷和歷史局限性日益凸顯,勞動教養(yǎng)制度面臨著越來越多的質(zhì)疑和挑戰(zhàn),現(xiàn)有勞教制度在理論基礎(chǔ)、制度設(shè)計和手段方法等方面存在著諸多問題,迫切需要對其進行改革,況且該制度目前已經(jīng)成為西方國家對我國人權(quán)保護狀況批評的一個焦點。因此,在我國社會主義法治國家發(fā)展的大背景下勞動教養(yǎng)制度改革勢在必行。 近年來,勞動教養(yǎng)制度方面的立法嚴(yán)重滯后和現(xiàn)有法律、法規(guī)的不完善而引發(fā)許多困惑與尷尬。特別是隨著《刑法》的修訂完善和《立法法》、《行政處罰法》等一系列涉及法律法規(guī)的頒布實施,勞動教養(yǎng)的存廢之爭一度也有愈演愈烈之勢?墒侨绻麖睦碚摵蛯嵺`兩個方面稍加觀察就會發(fā)現(xiàn),雖然勞動教養(yǎng)的名稱有可能作些調(diào)整,也可以對勞動教養(yǎng)的決定程序和執(zhí)行方式有必要不斷完善,但是從根本上廢除勞動教養(yǎng)制度的時機尚不成熟。因此,本文試圖從分析勞動教養(yǎng)制度的實際境況出發(fā),認(rèn)真分析勞動教養(yǎng)制度本身的境遇以及其所處的我國現(xiàn)階段法治狀況,尋求勞動教養(yǎng)制度改革的正確途徑和有效措施,這些對于完善我國的社會主義法制建設(shè),加強公民的人身權(quán)利和財產(chǎn)權(quán)利的保障,構(gòu)建社會主義和諧社會,具有非常重要的現(xiàn)實意義。本文作者從社會主義法治理念的角度出發(fā),對現(xiàn)行的勞動教養(yǎng)法律制度在保證公民權(quán)利、維護社會穩(wěn)定、與現(xiàn)行法律法規(guī)的沖突和實踐執(zhí)行中存在著嚴(yán)重的弊端等不足之處進行分析和透視,以期能夠找到一套不僅適合勞動教養(yǎng)制度自身發(fā)展的規(guī)律性制度,而且這項制度還能夠符合我國社會主義法治發(fā)展的要求。
[Abstract]:The system of reeducation through labor is an original legal system of our country. Since its establishment, it has played a unique role in maintaining national security and social stability, preventing and reducing illegal crimes, and educating and saving young people.However, with the development of politics, economy, culture and so on in our country, especially the establishment of the general plan of "governing the country according to law and building a socialist country ruled by law" and the increasing attention paid to the protection of human rights,The defects and historical limitations of the system of re-education through labor are increasingly prominent. The system of re-education through labor is facing more and more questions and challenges. The existing system of re-education through labour has many problems in the theoretical basis, system design and methods.There is an urgent need to reform it, and the system has become a focus of criticism of China's human rights protection in western countries.Therefore, it is imperative to reform the reeducation through labor system under the background of the development of the socialist country ruled by law in our country.In recent years, the legislation of reeducation through labor system lags behind seriously and the existing laws and regulations are not perfect, which leads to a lot of confusion and embarrassment.Especially with the revision and perfection of the Criminal Law, the Legislative Law, the Administrative punishment Law, and so on, a series of laws and regulations have been promulgated and implemented, so the debate on the retention and abolition of re-education through labor has once become more and more intense.However, if we look at both the theory and the practice, we will find that although the name of re-education through labour may be adjusted, it may also be necessary to continuously improve the decision procedure and mode of execution of re-education through labour.But the time to abolish the system of reeducation through labor is not ripe.Therefore, this paper tries to analyze the actual situation of the re-education through labor system, seriously analyzes the situation of the re-education through labor system itself and the current situation of the rule of law in our country, and seeks the correct ways and effective measures for the reform of the re-education through labor system.These are of great practical significance for perfecting the construction of socialist legal system, strengthening the protection of citizens' personal and property rights, and building a harmonious socialist society.From the point of view of the idea of socialist rule of law, the author of this paper makes an analysis of the current legal system of reeducation through labor in order to guarantee the rights of citizens and maintain social stability.In order to find a regular system which is not only suitable for the development of the system of re-education through labor, but also the conflict with the current laws and regulations and the serious shortcomings in the practice,Moreover, this system can also meet the requirements of the development of socialist rule of law in our country.
