【摘要】：知識產(chǎn)權訴訟案件往往伴隨著高度專業(yè)性、復雜性,所涉及的爭議焦點通常是超出一般人所能掌握的尖端科學技術,如果不能對這些技術問題進行充分專業(yè)的鑒定和說明,將導致訴訟難以順利進行�？梢�,知識產(chǎn)權司法鑒定對于知識產(chǎn)權訴訟的審理具有重要作用,而知識產(chǎn)權司法鑒定機構及鑒定人,專家輔助人,新興的技術調(diào)查官這三大類主體在知識產(chǎn)權司法鑒定中則扮演著相當重要的角色。論文首先在明確何為知識產(chǎn)權司法鑒定的前提下,從知識產(chǎn)權司法鑒定主體的概念入手,分析其在知識產(chǎn)權司法鑒定中起到的具體作用以及他們之間的聯(lián)系與區(qū)別。其次,剖析了知識產(chǎn)權司法鑒定主體制度在實際運行中存在的一些問題,如知識產(chǎn)權司法鑒定人才稀缺,鑒定機構的管理和使用銜接脫節(jié),專家輔助人不夠中立客觀,技術調(diào)查官的職能定位不明確,這些問題的存在嚴重制約了知識產(chǎn)權司法鑒定應有的功能發(fā)揮。再次,針對上述問題,運用比較的方法,對中外知識產(chǎn)權司法鑒定主體制度進行對比,綜合研究了英美法系與大陸法系國家的相關規(guī)定對我國的啟示。最后提出了完善我國知識產(chǎn)權司法鑒定主體制度的建議,如多種方式培養(yǎng)知識產(chǎn)權司法鑒定人才,成立知識產(chǎn)權司法鑒定共同體。推進知識產(chǎn)權司法鑒定機構行業(yè)能力水平建設,建立鑒定機構統(tǒng)一的管理制度,規(guī)范專家輔助人在知識產(chǎn)權司法鑒定中的相關權利義務與責任,細化技術調(diào)查官在知識產(chǎn)權訴訟中應承擔的司法鑒定職能等。希望通過本篇論文的相關闡述能夠?qū)ξ覈R產(chǎn)權司法鑒定在實踐中應用有所助益。
[Abstract]:Lawsuit of intellectual property rights is often accompanied by a high degree of professionalism, complexity, the controversy involved is usually beyond the advanced science and technology people can grasp, if not fully professional identification and description of these technical problems, will lead to litigation to go smoothly. Therefore, the judicial identification of intellectual property plays an important role in knowledge the property of the trial proceedings, and the intellectual property rights of judicial authentication institutions and identification, expert assisted, emerging technology investigators, these three kinds of subjects in the judicial identification of intellectual property has played a very important role. Firstly, what is clear in the premise of judicial identification of intellectual property under the concept of the judicial identification of the main body of knowledge property rights, the specific role in the analysis of the judicial identification of intellectual property plays as well as their relations and differences. Secondly, analyzes the intellectual property judicial authentication Some problems existing in the operation of the main system, such as the judicial identification of intellectual talent scarcity, appraisal institutions disjointed management and use of cohesion, the expert assistant is not neutral and objective functions, positioning technology officer is not clear, the existence of these problems seriously restrict the function of judicial identification of intellectual property due to play. Once again, the the problem, using the method of comparison, comparison of the Chinese and foreign intellectual property judicial appraisal system, a comprehensive study of the implications of the relevant provisions of the common law and civil law countries in China. Finally, put forward to perfect our judicial identification of the main system of intellectual property rights, such as a variety of ways to cultivate talents of judicial identification of intellectual property rights, the establishment of the judicial identification of intellectual property. The intellectual property community to promote the judicial authentication institutions industry ability construction, establish unified management system authentication institutions, The relevant rights and obligations and responsibilities of the expert assistant in the specification of intellectual property in judicial expertise, refining technology investigators should undertake in the intellectual property litigation in the judicial functions. Hope that through the related elaboration this thesis will be useful for the application of judicial identification of China's intellectual property rights in practice.
