【摘要】： 遷徙自由作為一項(xiàng)基本的人權(quán)被世界上大多數(shù)國(guó)家承認(rèn)并寫入憲法,以促進(jìn)它的保障和實(shí)施。我國(guó)在建國(guó)初期的1954年《憲法》中也有關(guān)于遷徙自由的規(guī)定,但是在后來(lái)的《戶口登記條例》等戶籍制度中開始對(duì)遷徙自由進(jìn)行限制,并在接下來(lái)的多部法律法規(guī)中都對(duì)遷徙自由進(jìn)行了限制性的規(guī)定。我國(guó)的1975年憲法、1978年憲法以及現(xiàn)行的1982年憲法都沒有關(guān)于遷徙自由的規(guī)定,這就使遷徙自由這項(xiàng)關(guān)系人身自由的基本人權(quán)難以得到根本的保障和實(shí)現(xiàn)。 我國(guó)對(duì)于遷徙自由的種種限制在很大程度上是由我國(guó)的戶籍制度造成的,戶籍制度本身的主要作用是對(duì)于人口的的統(tǒng)計(jì),然而我國(guó)的戶籍制度卻附加了種種的其他的對(duì)于人口遷移的限制,這些限制使外地人和農(nóng)村人在城市的各項(xiàng)權(quán)利很難實(shí)現(xiàn),尤其是農(nóng)民工的各項(xiàng)權(quán)利和利益受到了極大的損害,這種對(duì)于人力資源的人為性限制在很大程度上阻礙了我國(guó)城市化的實(shí)現(xiàn)和經(jīng)濟(jì)的快速增長(zhǎng),不利于我國(guó)共同富裕目標(biāo)的實(shí)現(xiàn)和我國(guó)和諧社會(huì)的建立。 戶籍制度的改革對(duì)我國(guó)的社會(huì)主義建設(shè)具有巨大的促進(jìn)作用,它可以促進(jìn)我國(guó)的政治民主化的進(jìn)一步實(shí)現(xiàn),可以促進(jìn)我國(guó)社會(huì)主義市場(chǎng)經(jīng)濟(jì)的快速良性發(fā)展,同時(shí)他還有利于實(shí)現(xiàn)我國(guó)的教育制度、社會(huì)福利制度等的完善。 最后,本文根據(jù)前面的分析對(duì)我國(guó)的戶籍制度的發(fā)展方向和遷徙自由的重新構(gòu)建提出建議：從短期目標(biāo)和遠(yuǎn)期計(jì)劃來(lái)重新實(shí)現(xiàn)我國(guó)的遷徙自由,進(jìn)而實(shí)現(xiàn)我國(guó)的政治、經(jīng)濟(jì)、教育、福利等的完善和發(fā)展,從而促進(jìn)我國(guó)社會(huì)主義和諧社會(huì)的發(fā)展。
[Abstract]:Freedom of movement, as a fundamental human right, has been recognized and enshrined in the Constitution of most countries in the world in order to promote its guarantee and implementation. The Constitution of 1954, in the early days of the founding of the people's Republic of China, also contained provisions on freedom of movement, However, in the later household registration regulations and other household registration systems, restrictions began to be imposed on freedom of movement. In the following several laws and regulations, restrictions on freedom of movement have been made. The Constitution of 1975, the Constitution of 1978 and the Constitution of 1982 do not contain any provisions on freedom of movement. This makes freedom of movement, a fundamental human right related to personal freedom, difficult to guarantee and realize. To a large extent, the restrictions on freedom of movement in our country are caused by our household registration system. The main function of the household registration system itself is the statistics of the population. However, the household registration system of our country has added a variety of other restrictions on population migration. These restrictions have made it difficult for outsiders and rural people to realize their rights in the cities, especially the rights and interests of migrant workers have been greatly damaged. This artificial restriction of human resources hinders to a great extent the realization of urbanization and the rapid economic growth in China, which is not conducive to the realization of the goal of common prosperity and the establishment of a harmonious society in our country. The reform of the household registration system plays a great role in promoting the socialist construction of our country. It can promote the further realization of our country's political democratization and promote the rapid and benign development of our socialist market economy. At the same time, he is also conducive to the realization of our country's education system, social welfare system and so on. Finally, according to the previous analysis, this paper puts forward some suggestions on the direction of the development of the household registration system and the reconstruction of the freedom of migration in China: from the short-term objectives and long-term plans to re-realize the freedom of migration in China, and then to realize the politics and economy of our country. The improvement and development of education and welfare will promote the development of socialist harmonious society in our country.
