【摘要】：社區(qū)矯正具有矯正效果明顯、矯正對(duì)象再犯罪率低等優(yōu)勢(shì)，是發(fā)達(dá)國家廣泛應(yīng)用的一種非監(jiān)禁類的刑罰執(zhí)行方式。未成年人社區(qū)矯正，是針對(duì)未成年人的心理和生理特點(diǎn)，在國家機(jī)關(guān)的指導(dǎo)和監(jiān)督下，通過相應(yīng)的矯正項(xiàng)目，讓未成年人在社區(qū)中進(jìn)行改造，旨在預(yù)防未成年人犯罪，注重教育挽救， 我國開展未成年人社區(qū)矯正既是必要的，也是可行的。它能夠充分發(fā)揮各方的協(xié)同力量，，共同挽救違法的未成年人；同時(shí)，未成年人的性格和行為習(xí)慣具有可塑性，社區(qū)自治的完善和社區(qū)居民素質(zhì)的提高也為矯正工作提供了客觀條件。 美國和英國是對(duì)未成年人進(jìn)行社區(qū)矯正比較早的國家，相關(guān)制度相對(duì)比較完善，研究英美未成年人社區(qū)矯正的立法、司法、程序運(yùn)行機(jī)制和矯正項(xiàng)目等，結(jié)合域外經(jīng)驗(yàn)，針對(duì)我國未成年人社區(qū)矯正存在的問題，為我國所借鑒，可以完善我國的未成年人社區(qū)矯正制度，具體措施有：加強(qiáng)未成年人社區(qū)矯正的立法；依法設(shè)立未成年人社區(qū)矯正的相關(guān)機(jī)構(gòu)；創(chuàng)設(shè)未成年人社區(qū)矯正項(xiàng)目；營造良好的未成年人社區(qū)矯正的人文環(huán)境。
[Abstract]:Community correction has the advantages of obvious correction effect, low re-crime rate and so on. It is a kind of non-custodial penalty execution method widely used in developed countries. Community correction of minors is aimed at the psychological and physiological characteristics of minors. Under the guidance and supervision of state organs, through the corresponding corrective projects, minors should be rehabilitated in the community with the aim of preventing juvenile delinquency and paying attention to education and rescue. It is necessary and feasible to carry out community correction for minors in our country. It can give full play to the concerted efforts of all parties to rescue minors who violate the law. At the same time, the minors' personality and behavior habits are plastic. The improvement of community autonomy and the improvement of community residents' quality also provide objective conditions for correction. The United States and Britain are relatively early countries in community correction for minors, and the relevant systems are relatively perfect. This paper studies the legislation, administration of justice, procedural operating mechanism and corrective projects for minors in the United States and the United States, and combines with extraterritorial experience. Aiming at the existing problems of minor community correction in our country, we can perfect the minor community correction system for our country. The concrete measures are as follows: strengthening the legislation of minor community correction; Set up the relevant organization of minor community correction according to law; establish minor community correction project; create good humane environment of minor community correction.
