【摘要】： 當(dāng)前,我國(guó)進(jìn)入了改革發(fā)展的關(guān)鍵期、機(jī)遇期。我們正在為全面建設(shè)小康社會(huì),構(gòu)建社會(huì)主義和諧社會(huì)而全力以赴。與此同時(shí),以往潛在的各種深層次矛盾進(jìn)入了凸顯期、多發(fā)期,誘發(fā)青少年犯罪的因素廣泛存在,青少年違法犯罪形勢(shì)相當(dāng)嚴(yán)峻,有人將青少年犯罪列為繼吸毒、環(huán)境污染之后的第三大世界難題。無(wú)庸諱言,青少年犯罪問(wèn)題已經(jīng)成為了一個(gè)世界性的難題。青少年是國(guó)家、社會(huì)未來(lái)的建設(shè)者和主人,對(duì)他們的教育的好壞直接關(guān)系到社會(huì)發(fā)展與國(guó)家富強(qiáng)。青少年犯罪不僅帶來(lái)嚴(yán)重的社會(huì)危害,也給青少年自身發(fā)展帶來(lái)傷害,給其家庭帶來(lái)不幸。青少年犯罪已成為一個(gè)十分敏感而又亟待解決的問(wèn)題。因此,研究分析當(dāng)前形勢(shì)下青少年犯罪的問(wèn)題,對(duì)更好的認(rèn)識(shí)和預(yù)防青少年犯罪具有非常重要的理論和現(xiàn)實(shí)意義。為了引起對(duì)青少年犯罪問(wèn)題的全面關(guān)注,加強(qiáng)對(duì)青少年犯罪的預(yù)防及對(duì)策,文章在其他學(xué)者研究基礎(chǔ)上,從青少年犯罪的基本問(wèn)題出發(fā)開始研究,明確了青少年犯罪研究的對(duì)象,將法律上的特定名詞“未成年人”犯罪研究與現(xiàn)實(shí)意義的“青少年”犯罪研究在概念上相區(qū)分,在理論研究上相統(tǒng)一。重視未成年人的犯罪研究,也不忽視未成年人擴(kuò)大的范疇-青少年的犯罪研究。詳細(xì)總結(jié)了在當(dāng)前社會(huì)環(huán)境下的青少年犯罪的行為表現(xiàn)和特點(diǎn),青少年犯罪的主體范圍日益擴(kuò)大,犯罪類型形形色色,青少年犯罪的形式變換多樣。文章在科學(xué)歸納調(diào)查取得的太原市萬(wàn)柏林區(qū)人民法院2000年度-2009年度統(tǒng)計(jì)數(shù)據(jù)這一第一手資料的基礎(chǔ)上,全面總結(jié),并靈活運(yùn)用經(jīng)驗(yàn)比較、實(shí)證分析的方法,研究青少年犯罪的社會(huì)影響,同時(shí)分析青少年犯罪的原因。重點(diǎn)研究如何在研究青少年犯罪行為的表現(xiàn)及影響之后,不僅從本學(xué)科的視角研究青少年犯罪,而且努力形成科際整合的研究范式,重視青少年犯罪研究實(shí)證方法的運(yùn)用,盡量依靠直接的觀察來(lái)發(fā)展、測(cè)試?yán)碚摵图僭O(shè),從而改變思辨和描述性研究方法。通過(guò)本研究,分析青少年犯罪的行為表現(xiàn)、特點(diǎn)及社會(huì)影響,青少年犯罪的原因,力求探索一條符合中國(guó)國(guó)情的青少年犯罪預(yù)防、教育、管理之路。
[Abstract]:At present, our country has entered the critical period of reform and development, the opportunity period. We are doing our best to build a well-off society in an all-round way and build a harmonious socialist society. At the same time, all kinds of potential deep-seated contradictions in the past have entered a prominent period. In frequent periods, the factors that induce juvenile delinquency are widespread, and the situation of juvenile delinquency is quite serious. Some people have listed juvenile delinquency as the third world problem after drug use and environmental pollution. Juvenile delinquency has become a worldwide problem. Teenagers are the builders and masters of the country and the future of society. The quality of their education is directly related to social development and the prosperity and strength of the country. Juvenile delinquency not only brings serious social harm, but also brings harm to the development of young people themselves. Bring misfortune to his family. Juvenile delinquency has become a very sensitive and urgent problem to be solved. Therefore, research and analysis of juvenile delinquency in the current situation, It is of great theoretical and practical significance to better understand and prevent juvenile delinquency. In order to arouse comprehensive attention to juvenile delinquency and strengthen the prevention and countermeasures of juvenile delinquency, this article is based on the research of other scholars. Starting from the basic problems of juvenile delinquency, this paper makes clear the object of the study of juvenile delinquency, and distinguishes the study of juvenile delinquency from the study of juvenile delinquency, which is a specific term in law, and the study of juvenile delinquency, which is of practical significance. Focusing on the research of juvenile delinquency and not neglecting the expanded category of juvenile delinquency. It summarizes in detail the behavior and characteristics of juvenile delinquency in the current social environment. The scope of the subject of juvenile delinquency is expanding day by day, and there are various types of crimes. The forms of juvenile delinquency are varied. On the basis of the first-hand data obtained by the people's Court of Wanbo District of Taiyuan City for the years 2000 to 2009, the paper sums up comprehensively and makes flexible use of experience comparison. The method of empirical analysis, the study of the social impact of juvenile delinquency, and the analysis of the causes of juvenile delinquency. After studying the performance and influence of juvenile delinquency, not only from the perspective of the subject, but also from the perspective of the subject, And try to form the research paradigm of inter-disciplinary integration, attach importance to the use of empirical methods in juvenile delinquency research, and try to rely on direct observation to develop, test theory and hypothesis, thus change the speculative and descriptive research methods. This paper analyzes the behavior, characteristics and social influence of juvenile delinquency, and the causes of juvenile delinquency, and tries to explore a way to prevent, educate and manage juvenile delinquency in accordance with China's national conditions.
