“天價烏木案”凸顯《物權(quán)法》適用之惑

＂High-priced Ebony＂ Case Highlights Confusions in the Application of Property Law

文章摘要：近來媒體廣為關(guān)注的“天價鳥木案”本質(zhì)上是一起無主物先占引起的權(quán)屬糾紛，由于《物權(quán)法》對于無主物先占制度采取了拒絕的立場，從而致使法院陷入無法可依的境地，筆者建議法院依法、科學、合理地運用法律賦予的自由裁量權(quán)，根據(jù)無主物先占制度的法理學說對本案作出判決，以推動立法最終承認無主物先占制度。從目前的情況看，法院試圖以發(fā)現(xiàn)埋藏物制度來解決本案的訴爭事項，筆者以為，《物權(quán)法》與《民法通則》關(guān)于發(fā)現(xiàn)埋藏物的規(guī)定完全不同，法律適用的邏輯與結(jié)果也不完全相同，而且，適用《物權(quán)法》第114條發(fā)現(xiàn)埋藏物“參照拾得遺失物的規(guī)定”既不符合實際情形，也會產(chǎn)生不公平的結(jié)果，更會使法院的法律適用邏輯難以自圓其說。有鑒于此，，筆者建議立法機關(guān)或最高司法機關(guān)重構(gòu)我國獨立的發(fā)現(xiàn)埋藏物制度。

Abstr：Recently widely covered ＂high-priced ebony＂ case in the media is essentially a dispute concerning occupatio of bona vacatia. The Property Law take a rejection position to the occupatio of bona vacatia, thereby resulting in the court into a situation without rules. I suggest that the court should use the fight of the discretion conferred by law legally, scientifically and rationally, and make a judgment for the present case catia, thus promoting the legislative according to the jurisprudence doctrine of occupatio of bona vaacknowledgement of occupatio of bona vacatia. In the current situation, the court is trying to solve disputable matters this case by thesaurii inventio. I think, Property Law and General Rules of Civil Law respectively have completely different provisions about thesaurii inventio, so do the logic and results of the application of the law. What＇s more, the application of Article 114 of the Property Law, which stipulates thesaurii inventio with reference to the provisions of lost-and-found objects, does not comply with the actual situation and will produce unfair results, which makes the court＇s application logic of law more difficult to justify. Given all those aspects, the author recommends that the legislature or the highest judicial organ to reconstruct our own thesaurii inventio regime.
