【摘要】：自然環(huán)境是人類(lèi)生存與發(fā)展的客觀基礎(chǔ)。隨著經(jīng)濟(jì)的增長(zhǎng),人口的增加以及城市化進(jìn)程的加快,各國(guó)的環(huán)境形勢(shì)日趨嚴(yán)峻。林業(yè)資源作為自然環(huán)境的重要組成部分,對(duì)自然環(huán)境的改善以及以及社會(huì)的發(fā)展起著重要作用,涉林犯罪也越來(lái)越為國(guó)家和學(xué)者們所重視。涉林犯罪由于其自身的特殊性,無(wú)論在理論層面還是實(shí)務(wù)層面,都存在著許多問(wèn)題。本文以現(xiàn)代我國(guó)通行的法學(xué)理論為標(biāo)尺,對(duì)我國(guó)歷史上出現(xiàn)的涉林犯罪的相關(guān)立法進(jìn)行分析。重點(diǎn)介紹先秦以及漢朝林業(yè)保護(hù)思想和唐、宋、明、清法典中涉林犯罪立法及演變,并在此基礎(chǔ)上,結(jié)合現(xiàn)代刑法學(xué)理論探討各主要?dú)v史時(shí)期涉林犯罪法律規(guī)定的特點(diǎn),并將這些特點(diǎn)與現(xiàn)行刑法存在問(wèn)題相比較,提出能夠?qū)裉斓纳媪址缸锪⒎ǜ母镉幸娴膮⒖家庖?jiàn)。
[Abstract]:The natural environment is the objective basis of human survival and development. With the growth of economy, the increase of population and the acceleration of urbanization, the environmental situation of various countries is becoming more and more serious. As an important part of the natural environment, forestry resources play an important role in the improvement of the natural environment and the development of society. Forest-related crimes have been paid more and more attention by countries and scholars. Because of its own particularity, there are many problems in theory and practice. Based on the popular legal theory in modern China, this paper analyzes the relevant legislation of forest-related crimes in the history of our country. This paper mainly introduces the forestry protection thought of pre-Qin and Han dynasties and the legislation and evolution of forest-related crimes in Tang, Song, Ming and Qing laws. On this basis, combined with the theory of modern criminal law, this paper probes into the characteristics of the legal provisions of forest-related crimes in each main historical period, and compares these characteristics with the existing problems of the current criminal law, and puts forward some useful reference opinions for today's legislative reform of forest-related crimes.
