區(qū)域行政立法協(xié)調(diào)研究

【摘要】:區(qū)域行政立法協(xié)調(diào)是我國現(xiàn)行行政立法體制在受到目前區(qū)域一體化發(fā)展趨勢的碰撞中提出來的,也是我國行政法學(xué)面臨的一個(gè)新課題。我國目前較成熟的經(jīng)濟(jì)區(qū)域有長三角區(qū)域、泛珠三角區(qū)域、京津冀區(qū)域、東北地區(qū)等,實(shí)踐中各個(gè)區(qū)域經(jīng)濟(jì)共同體都展開了各種不同形式的政府協(xié)調(diào)與合作。本文在梳理區(qū)域行政立法協(xié)調(diào)的基本概念的基礎(chǔ)之上,分析我國區(qū)域行政立法協(xié)調(diào)的現(xiàn)實(shí)基礎(chǔ),并借鑒美國的州際協(xié)定,提出建構(gòu)及完善我國區(qū)域行政立法協(xié)調(diào)機(jī)制的建議。本文包括引言,共有五個(gè)部分: 引言部分概要地介紹了我國區(qū)域行政立法協(xié)調(diào)的背景,提出問題。指出區(qū)域行政立法協(xié)調(diào)機(jī)制是為了在區(qū)域內(nèi)建立一個(gè)協(xié)調(diào)統(tǒng)一的法制環(huán)境,將區(qū)域治理納入法治化軌道。 第一章是對區(qū)域行政立法協(xié)調(diào)的概念界定以及目前我國區(qū)域協(xié)調(diào)現(xiàn)狀分析。本章介紹了目前我國各區(qū)域政府展開的多種合作與協(xié)調(diào)方式,提出了實(shí)踐中存在的問題,如法制方面的協(xié)調(diào),呈現(xiàn)出松散的狀態(tài),尚未常規(guī)化、系統(tǒng)化、定型化,缺乏必要的法律基礎(chǔ),導(dǎo)致執(zhí)行力缺乏,協(xié)調(diào)效果不理想。并對導(dǎo)致這些問題的原因進(jìn)行了反思。 第二章分析了我國區(qū)域行政立法協(xié)調(diào)的理論基礎(chǔ)與社會基礎(chǔ)。隨著新區(qū)域主義理論與區(qū)域行政的興起,區(qū)域行政立法協(xié)調(diào)變得非常必要:一是能協(xié)調(diào)地方行政規(guī)范的橫向沖突,二是可為區(qū)域一體化提供法制保障。 第三章分析美國州際協(xié)定在協(xié)調(diào)州際立法上所體現(xiàn)出來的協(xié)作理念和模式,它為我國提供了可資借鑒的經(jīng)驗(yàn):在保持既有行政區(qū)劃的前提下,各地方政府可在平等協(xié)商的基礎(chǔ)上以簽訂行政協(xié)議的方式達(dá)成立法協(xié)調(diào)的目的。 第四章建構(gòu)我國區(qū)域行政立法協(xié)調(diào)制度。本章是對前三章提出問題的回應(yīng),在借鑒美國經(jīng)驗(yàn)的基礎(chǔ)上,對建構(gòu)和完善我國的區(qū)域行政立法協(xié)調(diào)機(jī)制提出建議:健全行政協(xié)議制度,完善立法協(xié)調(diào)的實(shí)施機(jī)制與程序機(jī)制,建立區(qū)域行政立法協(xié)調(diào)的爭端解決機(jī)制,以及相配套的其他機(jī)制如利益補(bǔ)償與分享機(jī)制、地方規(guī)章清理機(jī)制、咨詢評估機(jī)制。?
[Abstract]:The coordination of regional administrative legislation is put forward by the collision of the current administrative legislation system of our country by the current development trend of regional integration, and it is also a new subject faced by the administrative law of our country. At present, the more mature economic regions in China are the Yangtze River Delta region, the Pan-Pearl River Delta region, the Beijing-Tianjin-Hebei region, the Northeast region and so on. In practice, various regional economic communities have carried out various forms of government coordination and cooperation. On the basis of combing the basic concept of regional administrative legislation coordination, this paper analyzes the realistic basis of regional administrative legislation coordination in our country, and draws lessons from the interstate agreement of the United States, and puts forward some suggestions for constructing and perfecting the coordination mechanism of regional administrative legislation in our country. This paper includes an introduction, a total of five parts: the introduction briefly introduces the background of regional administrative legislation coordination in China, and puts forward problems. It is pointed out that the coordination mechanism of regional administrative legislation is to establish a coordinated and unified legal environment in the region and bring regional governance into the track of legalization. The first chapter is the definition of the concept of regional administrative legislation coordination and the current situation of regional coordination in China. This chapter introduces many kinds of cooperation and coordination methods carried out by the regional governments in our country at present, and puts forward the problems existing in practice, such as the coordination of the legal system, which is in a loose state, which is not routine, systematic, stereotyped, and lacks the necessary legal basis, which leads to the lack of executive power and the unsatisfactory coordination effect. And the causes of these problems are reflected. The second chapter analyzes the theoretical and social basis of the coordination of regional administrative legislation in China. With the rise of new regionalism theory and regional administration, the coordination of regional administrative legislation has become very necessary: one is to coordinate the horizontal conflict of local administrative norms, the other is to provide legal guarantee for regional integration. The third chapter analyzes the cooperative concept and mode embodied in the coordination of interstate legislation in the United States, which provides our country with useful experience: on the premise of maintaining the existing administrative divisions, the local governments can achieve the purpose of legislative coordination by signing administrative agreements on the basis of equal negotiation. The fourth chapter constructs the coordination system of regional administrative legislation in our country. This chapter is a response to the questions raised in the first three chapters. On the basis of drawing lessons from the experience of the United States, this chapter puts forward some suggestions on the construction and improvement of the coordination mechanism of regional administrative legislation in our country: perfecting the administrative agreement system, perfecting the implementation mechanism and procedural mechanism of legislative coordination, establishing the dispute settlement mechanism of regional administrative legislation coordination, and other supporting mechanisms, such as benefit compensation and sharing mechanism, and local regulations cleaning mechanism.
