【摘要】：“332條款”是美國USITC就關(guān)稅和貿(mào)易態(tài)勢進(jìn)行“常規(guī)性事實調(diào)查”所應(yīng)遵循的規(guī)范�！�332條款”調(diào)查的最終報告并不包含任何政策性建議，亦不得為任何由總統(tǒng)實施的貿(mào)易行動提供法律依據(jù)，但它往往是引起反傾銷、反補(bǔ)貼等貿(mào)易救濟(jì)措施的“先兆”。 本文對“332條款”的具體規(guī)則進(jìn)行了比較詳細(xì)的分析，并將其與傳統(tǒng)的反傾銷、反補(bǔ)貼、保障措施、“337條款”和“301條款”等貿(mào)易措施進(jìn)行比較，采用數(shù)據(jù)統(tǒng)計、案例分析等研究方法，分析了“332調(diào)查”的實踐，進(jìn)而對我國在出口貿(mào)易中何以應(yīng)對“332調(diào)查”和中國貿(mào)易法相關(guān)條款的完善提出了建議。
[Abstract]:Section 332 is the norm to be followed by the United States USITC to conduct a "regular fact-finding" of customs and trade trends. The final report of the Section 332 investigation does not contain any policy recommendations. Nor does it provide a legal basis for any trade action carried out by the President, but it is often a "precursor" to trade remedies such as anti-dumping, countervailing and so on. This paper makes a detailed analysis of the specific rules of Section 332, and compares it with the traditional trade measures such as anti-dumping, countervailing, safeguard measures, Section 337 and Section 301, etc., and adopts the statistics, and makes a comparison between them and traditional trade measures, such as Anti-dumping, countervailing, safeguard measures, Section 337 and Section 301. This paper analyzes the practice of "332 investigation" by means of case analysis, and then puts forward some suggestions on how to deal with the "332 investigation" and the improvement of the relevant provisions of China's trade law in the course of export trade.
