【摘要】：隨著中國法制現(xiàn)代化地不斷推進(jìn),我國在立法層面上與司法層面上的改革存在一定的脫節(jié),譬如在審判監(jiān)督程序上。本文通過對中國古代錄囚制度的分析,找出其可為現(xiàn)代審判程序借鑒之處,建議強(qiáng)化當(dāng)前審判監(jiān)督程序主動性以及不要過度依賴制度,提高偵查和起訴環(huán)節(jié)的糾錯能力,吸收古代錄囚中"慎刑"、"仁道"的司法理念,給審判監(jiān)督注入新的司法內(nèi)涵,以提高當(dāng)前審判監(jiān)督程序的作用和效率。
[Abstract]:With the modernization of the legal system in China, there is a certain disconnect between the reform on the legislative level and the judicial level, for example, in the procedure of judicial supervision. Based on the analysis of the system of prison placement in ancient China, this paper finds out what it can be used for reference in the modern trial procedure, and suggests to strengthen the initiative of the current trial supervision procedure and not to rely too much on the system, so as to improve the error correction ability of the investigative and prosecutorial links. In order to improve the function and efficiency of the current trial supervision procedure, the judicial concept of "careful punishment" and "benevolence" in ancient prisoners is absorbed, and a new judicial connotation is injected into the judicial supervision.
