【摘要】：南京國(guó)民政府創(chuàng)設(shè)了法庭調(diào)解制度,相比傳統(tǒng)中國(guó)的官方調(diào)處,其有著近代化的制度特征,在主體、場(chǎng)所、強(qiáng)制性、程序諸方面都表現(xiàn)出規(guī)范化的路徑取向。龍泉司法檔案收錄的案卷則展現(xiàn)了實(shí)際生活中該制度的運(yùn)行狀況及其效果,帶來(lái)對(duì)法庭調(diào)解制度的微觀、中觀、宏觀三個(gè)層面的觀察。在微觀層面,法庭調(diào)解制度在龍泉縣取得了不錯(cuò)的效果,有著相對(duì)較高的調(diào)解成功率,并在不同類型的案件中呈現(xiàn)不同的效果。在中觀層面,法庭調(diào)解實(shí)踐反映出場(chǎng)域?qū)χ贫鹊膶?shí)踐及其效果的達(dá)成有著重要的影響。在宏觀層面,對(duì)法庭調(diào)解制度實(shí)踐的分析揭示了制度與實(shí)踐的關(guān)系問(wèn)題只有置于國(guó)家與社會(huì)的關(guān)系框架中才能被更深刻地理解。
[Abstract]:Nanjing National Government established the court mediation system. Compared with the traditional Chinese official mediation, it has modern system characteristics. In the main body, place, mandatory, procedure and other aspects, it shows a standardized path orientation. The case files collected in Longquan judicial file show the operating status and effect of the system in real life, and bring about the observation of the court mediation system from three aspects: micro, medium and macro. At the micro level, the court mediation system has achieved good results in Longquan County, has a relatively high mediation success rate, and presented different effects in different types of cases. In the middle level, the practice of court mediation reflects that the field has an important influence on the practice of the system and the achievement of its effect. At the macro level, the analysis of the practice of the court mediation system reveals that the relationship between the system and practice can only be understood more deeply in the framework of the relationship between the state and the society.
