【摘要】：當今人類對未來世界的影響日益巨大，可持續(xù)發(fā)展成為時代共識。要實現可持續(xù)發(fā)展，后世人權利與現世人義務成為其中不可回避的話題。緒論介紹了選題背景、國內外后代人權利法律保障研究的現狀、后代人權利的內涵、研究的意義、研究的創(chuàng)新點和研究方法。第二章分別從自然權利理論、代際公平理論、代際交叉理論、正義存儲理論四個理論層面論證了后代人權利保障的理論基礎。第三章主要整理了部分國家后代人權利法律保障的國內法規(guī)范，國際條約、宣言及法律文件中的相關規(guī)范以及相關司法判決。第四章對后代人權利法律保障所面臨的現實困境進行了闡述，包括當代民主決策制度安排下后代人的主體缺位與補償性正義原則指導下后代人權利保障的局限性。第五章論述了后代人權利法律保障具有必要性和可行性，，提出建立違憲審查制度和確立風險管理原則以保護后代人的權利，并就構建后代人權利救濟制度提出了具體建議。第六章是結束語，主要說明了后代人權利保障理論的發(fā)展空間和本文研究還需改進和完善之處。
[Abstract]:Today's human influence on the future world is increasingly great, sustainable development has become the consensus of the times. In order to achieve sustainable development, the rights of the world and the obligations of the present world have become an unavoidable topic. The introduction introduces the background of the topic selection, the status quo of the legal protection of future generations' rights at home and abroad, the connotation, significance, innovation and research methods of future generations' rights. The second chapter demonstrates the theoretical basis of the rights protection of future generations from four theoretical levels: natural rights theory, inter-generational justice theory, intergenerational intersection theory and justice storage theory. The third chapter mainly arranges the domestic legal norms, international treaties, declarations and legal documents, as well as the relevant judicial decisions of the legal protection of the rights of future generations in some countries. The fourth chapter expounds the realistic dilemma of the legal protection of the rights of future generations, including the absence of subjects under the arrangement of contemporary democratic decision-making system and the limitations of the rights protection of future generations under the guidance of the principle of compensatory justice. The fifth chapter discusses the necessity and feasibility of legal protection of the rights of future generations, puts forward the establishment of unconstitutional review system and the establishment of risk management principles to protect the rights of future generations, and puts forward concrete suggestions on the establishment of rights relief system for future generations. The sixth chapter is the conclusion, which mainly explains the development space of the theory of rights protection for future generations and the improvement and perfection of the research in this paper.
