【摘要】：1954年,李達(dá)撰寫(xiě)了一系列文章和著作,宣傳和闡釋新中國(guó)憲法。在這些著作中,他論述了新中國(guó)憲法產(chǎn)生的背景、性質(zhì),探討了新中國(guó)憲法的三個(gè)基本問(wèn)題,揭示了新憲法的意義。李達(dá)的憲法學(xué)思想立足于唯物史觀(guān),將憲法學(xué)研究奠基于唯物史觀(guān)的基礎(chǔ)之上;以馬克思主義方法論原則為指導(dǎo),考察憲法學(xué)問(wèn)題;從中國(guó)的具體實(shí)際出發(fā),緊密聯(lián)系中國(guó)社會(huì)實(shí)際來(lái)開(kāi)展憲法學(xué)研究。他揭示了憲法的本質(zhì)、意義和特點(diǎn)以及考察憲法的方法,并指出了馬克思主義憲法學(xué)中國(guó)化的實(shí)現(xiàn)路徑,建構(gòu)了中國(guó)化馬克思主義憲法學(xué)體系。
[Abstract]:In 1954, Li Da wrote a series of articles and works to promote and interpret the New China Constitution. In these works, he discusses the background and nature of the new Chinese constitution, probes into three basic problems of the new Chinese constitution, and reveals the significance of the new constitution. Li Da's thought of constitutional law is based on historical materialism, and the study of constitutional law is based on historical materialism, under the guidance of Marxist methodological principles, the study of constitutional jurisprudence is investigated. From the specific reality of China, closely linked to the reality of Chinese society to carry out constitutional studies. He reveals the essence, significance and characteristics of the constitution and the method of examining the constitution, points out the way to realize the Sinicization of Marxist constitutional law, and constructs the system of the constitutional law of Marxism in China.
