【摘要】：本文以英國(guó)行政監(jiān)察專員制度為研究對(duì)象,首先對(duì)該制度的發(fā)展歷程、具體運(yùn)作模式、發(fā)展趨勢(shì)等內(nèi)容進(jìn)行了詳細(xì)介紹,并對(duì)該制度的主要問題予以了分析說明。然后通過對(duì)英國(guó)行政監(jiān)察專員在英國(guó)行政法治體系中所扮演的角色和地位的把握,分析了英國(guó)行政監(jiān)察專員制度的成效機(jī)理,并借此為我國(guó)行政法治建設(shè)的完善提供了相應(yīng)參考。 本文由五部分組成,第一部分通過英國(guó)行政監(jiān)察專員制度的起源與歷史發(fā)展的介紹及其在英國(guó)行政法治體制中的角色與地位的分析,對(duì)英國(guó)行政監(jiān)察專員的概況予以說明。第二部分則根據(jù)英國(guó)行政監(jiān)察專員的分類對(duì)英國(guó)公共部門的行政監(jiān)察專員類型及其運(yùn)作模式予以介紹。第三部分則對(duì)英國(guó)行政監(jiān)察專員幾個(gè)主要問題,即議員過濾機(jī)制的存廢問題、主動(dòng)調(diào)查權(quán)問題、如何保持獨(dú)立性以及對(duì)如何保證有效性的問題,做出了特別的說明與分析。第四部分首先介紹分析了英國(guó)行政監(jiān)察專員所取得的成效及其運(yùn)行機(jī)理,然后對(duì)該制度的優(yōu)缺點(diǎn)進(jìn)行分析,并從英國(guó)行政監(jiān)察專員的機(jī)構(gòu)改革、角色扮演的轉(zhuǎn)化以及制度本身的完善三方面說明了該制度今后的發(fā)展趨勢(shì)。最后,本文還通過對(duì)中英兩國(guó)的行政法制機(jī)理比較,對(duì)如何借鑒行政監(jiān)察專員制度完善我國(guó)行政法治建設(shè)提出了幾點(diǎn)建議。 本文主要采用了文獻(xiàn)研究方法,筆者為詳細(xì)介紹英國(guó)行政監(jiān)察專員制度搜集了一手的外文資料,這些文獻(xiàn)具有一定的權(quán)威性與時(shí)效性,反映了該制度的最新發(fā)展。本文還運(yùn)用了比較分析的研究方法,通過行政監(jiān)察專員制度與議會(huì)監(jiān)督機(jī)制、司法審查制度、行政機(jī)關(guān)內(nèi)部申訴機(jī)制的比較,借以使人們更好的了解英國(guó)行政監(jiān)察專員的具體機(jī)制、功能與作用。
[Abstract]:This article takes the British administrative inspector system as the research object, first of all, the development course, the concrete operation mode, the development tendency and so on contents of the system are introduced in detail, and the main problems of the system are analyzed and explained. Then it analyzes the effective mechanism of the British administrative ombudsman system by grasping the role and position of the British administrative ombudsman in the British administrative rule of law system. And this provides the corresponding reference for our country administrative rule of law construction consummation. This paper consists of five parts. In the first part, through the introduction of the origin and historical development of the British administrative ombudsman system and the analysis of its role and status in the British administrative rule of law system, the general situation of the British administrative ombudsman is explained. The second part introduces the types and operation mode of the British Public sector Administrative Ombudsman according to the classification of the British Administrative Ombudsman. The third part makes a special explanation and analysis on several main problems of the British Administrative Ombudsman, namely, the issue of the retention and abolition of the filter mechanism of the members of Parliament, the issue of active investigation power, how to maintain independence and how to ensure the effectiveness. The fourth part first introduces and analyzes the results and the operating mechanism of the British Administrative Ombudsman, then analyzes the advantages and disadvantages of the system, and analyzes the institutional reform of the British Administrative Ombudsman. The transformation of role-playing and the perfection of the system itself illustrate the development trend of the system in the future. Finally, by comparing the mechanism of administrative legal system between China and Britain, this paper puts forward some suggestions on how to use the administrative inspector system for reference to perfect the construction of administrative rule of law in our country. This article mainly uses the literature research method, the author has collected the primary foreign language data for the detailed introduction the British administrative inspector system, these documents have certain authority and the timeliness, has reflected this system the newest development. This article also uses the comparative analysis research method, through the administrative ombudsman system and the parliamentary supervision mechanism, the judicial review system, the administrative organ internal appeal mechanism comparison, So that people can better understand the specific mechanism, function and function of the British Administrative Ombudsman.
