【摘要】：正岡紹夫的封建主義是法律意義上的慣例,一種法律關(guān)系或法律制度,即封臣契約(封建契約)衍生的一系列法律權(quán)利和義務(wù),主要包括封君與封臣的人身依附關(guān)系,封君與封臣對(duì)于封土的權(quán)利,封土的司法權(quán)。對(duì)于西歐中世紀(jì)史研究,這種法律研究路徑可以給我們以新的啟示。
[Abstract]:Zhenggang Shaofu's feudalism is the practice in the sense of law, a kind of legal relationship or legal system, namely a series of legal rights and obligations derived from the consecration of vassal (feudal contract), mainly including the personal attachment between the monarch and the vassal. Fengjun and officials of the rights of the feudal land, the jurisdiction of the feudal land. For the study of medieval history in Western Europe, this path of legal research can give us new enlightenment.
