【摘要】：法律隱喻的存在使得法律工作者在法律裁決等法律解釋的過(guò)程中可以操縱話語(yǔ),法律和隱喻二者之間存在辯證性關(guān)系,法律為隱喻轉(zhuǎn)換的實(shí)現(xiàn)提供了必要的語(yǔ)言環(huán)境,隱喻則為法律話語(yǔ)說(shuō)服功能的實(shí)現(xiàn)提供了一定的途徑。法律隱喻具有形象化、具體化、合法化、概念化以及自我的肯定表征和他人的否定表征五大說(shuō)服功能。同時(shí),法律隱喻還具有對(duì)個(gè)體思維的說(shuō)服、對(duì)特殊聽(tīng)眾的說(shuō)服以及對(duì)普通聽(tīng)眾的說(shuō)服三大分層說(shuō)服功能。
[Abstract]:The existence of legal metaphor enables legal workers to manipulate discourse in the process of legal interpretation such as legal adjudication, and there is a dialectical relationship between law and metaphor, which provides the necessary linguistic environment for the realization of metaphorical transformation. Metaphor provides a certain way to realize the function of legal discourse persuasion. Legal metaphor has five persuasive functions: visualization, concretization, legalization, conceptualization, positive representation of self and negation of others. At the same time, legal metaphor has three functions: persuasion of individual thinking, persuasion of special listeners and persuasion of ordinary listeners.
