雙重博弈結(jié)構(gòu)下士大夫法律觀及現(xiàn)代法治思考

【摘要】:作為社會(huì)性的法,法學(xué)研究與法律制度構(gòu)建均需要"本土化"與"人性"的雙重歷史考量。作為古代社會(huì)精英的士大夫,出身于古代宗親體制下的家庭,積極入仕治國,進(jìn)可操手法律運(yùn)行,成為社會(huì)治理之中堅(jiān);退亦可修身與齊家,是社會(huì)結(jié)構(gòu)中"身份利益"與"精神信仰"兼具的最具流動(dòng)性的群體。該種"身份"與"信仰"雙重博弈結(jié)構(gòu)特性衍生出的"強(qiáng)""弱"激勵(lì)配置,解釋了我國古代社會(huì)家法何以被預(yù)留自治、程序不被重視等問題。中國人的關(guān)系存在比法治信仰更為強(qiáng)勢束縛現(xiàn)代法治建設(shè),道德化策略難以挽回當(dāng)今"司法不被信任"的社會(huì)心理。制度化策略應(yīng)是我國新一輪司法改革大背景下法治建設(shè)的進(jìn)路。
[Abstract]:As a social law, both legal research and legal system construction need the dual historical consideration of "localization" and "humanity". As the elite of the ancient society, the literati came from the family under the ancient patriarchal system, actively entered the official country and operated the law, and became the backbone of the social governance. It is the most mobile group in the social structure of "identity interests" and "spiritual beliefs". This kind of "identity" and "belief" double game structure derived from the "strong" and "weak" incentive configuration, explained why the ancient Chinese social family law was reserved for autonomy, the procedure was not attached importance to, and so on. The relationship of Chinese people is more powerful than the belief in the rule of law to restrain the construction of modern rule of law, and the moralization strategy can hardly redeem the social psychology of "judicature is not trusted". The institutionalization strategy should be the way to the construction of the rule of law under the background of the new round of judicial reform in our country.
